Brandy Casino refuses to pay my 20925$ win
Brandy had this promotion last month called 'Test Drive x 10' where you send them 20$ through a web form and they opened you an account (seperate from your main one) with 200$ in it. The catch was that you had to reach a 19000$ balance before you could cash out. They also offered '2/20/reach 2000' and '200/2000/reach 180k' accounts.
From reading the terms, there was no doubt in my mind that this was available on more than one deposit. So I did make a 20$ deposit, got a 200$ account, lost, made a second 20$ deposit, was emailed a second 200$ account, and so forth, many times (25, I believe) over the course of four days, until I hit a 20000$ Royal Flush. After hitting the Royal Flush I emailed Brandy, asking them to cashout my winnings (the cashier module was not available in those special accounts).
According to the rules of the promotion, I was supposed to be paid in 24 hours so, two days later, not having received my winnings, I emailed to inquire about my payment and the answer I received is that they are not going to pay me because I broke the rules of the promotion by having multiple bonus accounts. They say that the rules state that only one account of each type is allowed per customer, which is not true. The rules don't say anything explicit like that at all.
The complete rules can be found at Brandy's own forum here : http://www.online-gambling-forums.com/index.pl?board=casino4;action=display;num=11567540 59
Not only is there no clear mention that only one bonus of each kind is allowed, but here is was they emailed me in answer to my sending the second 20$ deposit :
Quote:
Dear xxxx,
Thank you for taking part in BrandyCasino’s promos!
Hereby we would like to inform you that according to BrandyCasino’s regulations, every Test Drive deposit is added into a new account. Therefore, your latest $20 deposit has been transferred from former TD00008 to new TD32825 (password xxxxx).
A relevant bonus has also been added to the new account.
Whenever you decide to make a new deposit for Test Drive promo, you will be informed of a new account number as soon as possible.
We apologize for any inconveniences that may have occurred.

This proves that they were perfectly aware that they were creating multiple accounts. In fact, for me, it was a clear confirmation that they were welcoming more deposits. The emails containing each new account's username and password were signed by a number of different people, and they all took a different time to arrive so they weren't automatic emails, they were manually processed.
Brandy was welcoming players to open multiple "TD" accounts apparently until I won and they realized that this was not to their taste.
Brandy has willingly accepted to open these accounts for me (remember that they created these accounts, not me). All the time I was playing, every sign was there to confirm to me that I was doing exactly what was intended by this promotion. And now, they paid back my 500$ in deposits and act like this is the end of it.
Manager Lisa Evans at first game me the impression that she was willing to have an open discussion, but it isn't the case.
Here are the facts that I brought to Lisa's attention and which she has entirely failed to address :
1- The fact that Brandy's refusal to pay my winnings is based on a quote that wasn't part of the terms and contions of the 'Test Drive x 10' promotion.
2- The fact that Brandy's staff were well aware that I had opened multiple 'Test Drive by 10' accounts, and that they welcomed me to open more.
3- The fact that these special accounts were created (and bonuses put in them for me to play with) by Brandy staff with during the course of FOUR days, and that it is only on the day after I signaled my win to Brandy that Brandy's practical interpretation of their own rules suddenly changed : my winning was denied, 'Test Drive X 10' deposits were suddenly refunded.
In order to justify Brandy's refusal to pay me, Lisa Evans was actually so desperate as to quote (with quotations marks and all) words that were not part of promotional rules :
Quote:
Dear xxxx,
I would like to congratulate you on winning that spin!
Meanwhile, I am sorry to inform you that our fraud department found out that some of the promo rules were misunderstood by several players which led to violation of promotional requirement which states that: “one player can get only one 2TD account, one 20TD account, and one 200TD account”.
All of the accounts which voided this requirement were frozen and deposits returned to the players.
I again apologize for any possible inconvenience caused and hope for your understanding and cooperation.
Warmest regards,
Lisa Evans

Lisa Evans need for after-the-fact rewording of the rules goes to show how what she wanted to see in the rules was just not there.

You have had this topic running at casinomeister the last 7 weeks, why haven't you received any help over there?

I guess because most people at the Casino Meister forum are players who have little leverage against Brandy. Every person who has voiced their opinion about my case agrees that Brandy has no ground for their refusal to pay me. I had hoped for such a consensus when I first made my dispute public and I had hoped that it would be enough to move Brandy towards settling my winnings. Unfortunately, the latter hasn't materalized.
As for Bryan Bailey, I filed a pitch-a-bitch complaint about 6 weeks ago and I haven't heard from him since. I emailed him a reminder about my complaint last week but that went unanswered too. I know he is always busy, and of course with the new US legislation he must be busier than ever.
I posted about my dispute here following Steven Corfman's suggestion. He said that he was willing to look into my dispute when time permits, which won't be before a couple more weeks. I have already informed Brandy that they should expect me to be patient and determined and that if they heard nothing from me for a while, they shouldn't conclude that I have dropped the ball.

A representative of Brandy responded upon the non-payment in their forum today. I am asking those interested to please join the discussion here:

Brandy needs to know that there will be consequences if they do not act properly and pay backjlack.

I support this player and we would probably have a good chance to get his winnings paid if we get over there and help out. Isn't this one of the most important reasons there exists a GPWA, to make sure casinos and players are kept in check?

The threat in Brandys forum has dried out already and the player is trying to get his money differently. I just wish that at least one of the brandy affiliates of this forum would have had theuts to step up here and try to help.

I used to promote them a while back but pulled them off my sites about 2 years ago because I heard problems about them. They never responded to affiliates, and if they don't respond to us, they will probably not respond to the players as well.
I believe this casino is a rogue and has been for some time now. I hope you get paid, I wish I had a contact their so I could help you out!
I helped a player get paid from Grand Banks Casino (Black Widow Casino included) even though he didn't even go through my site, it was hard but they paid him the $2000 they had owed him. It was a long battle, but I helped the player out
