    To most large companies, it's quick and easy to take someone to WIPO. As long as it is not complicated, the respondent (domain holder) is unwilling to show-up or fight, and it is just a few thousand dollars to file and have your domains transferred to them. In this case, Brightshare could sue the He%$ out of them. Under ICANN (UDRP Uniform Rule 18. a. and b.) Policy, they can push it straight to court in the country in which the domain was registered (ICANN Policy). They will not win because it was registered in "bad faith" under the ICANN Rules below:

    UDRP Uniforrm Rule
    3. (b) (ix)

    (1) the manner in which the domain name(s) is/are identical or confusingly similar to a trademark or service mark in which the Complainant has rights; and (2) why the Respondent (domain-name holder) should be considered as having no rights or legitimate interests in respect of the domain name(s) that is/are the subject of the complaint; and
    (3) why the domain name(s) should be considered as having been registered and being used in bad faith


    They will do nothing because they are cowards who go after individuals, and not corporations. Even though Brightshare would lose, there is still the chance that they could push it to a court and put Microgaming in Check. Instead of it costing Microgaming a few thousand, it would cost them over $100,000+. This will never happen.

    If it were one of us, they would take us in a minute in this case.

    I know an affiliate who owns a microgaming domain and they got a letter from microgaming lawyer.He agreed to put only microgaming products on the domain and 2+ years later he still owns it.I am not going to disclose the domain in case they have a change of heart if they see this post but maybe if you guys get a letter you can try that route.Last time i looked his domain had 3 pages on it and about 15 microgaming casinos and bingo rooms.It has no out links to other websites which i believe may have been a condition as well.

    This is how things used to be. They are many sites who have no problem with you owning a domain in this way, as long as you are advertising them. In the end, they end-up making money and so do you. It's good business. I can understand if someone is being dishonest. But there should at least be a discussion on the matter first, before strong-arming people.

    I think most keep low profile and ignore the lawyers emails.

    One should not forget however that by not replying you are in violation as well and IF they can prove you have damaged their brand/domain etc the amounts for a compensation can mount up the longer you have the domain with content online.

    That's very true. In the US, a cease and desist is very serious and I responded to mine with a legal reply. The claim has to be valid in order to satisfy the 3 criteria of UDRP and they had no case and were actually violating US laws. I would say that if someone purchases a domain quickly, for the reason of trading on someone's brand, and has actually purchased it in "bad faith", they are guilty. If you are not guilty than you need to respond legally, as you said, then move forward. In my case, I felt it important to expose these guys because they are trying to con affiliates out of their domains by forcing them to hand-them-over for free. In the US, that's illegal. My brand name, "32x", predates the internet and thier company. It is a term that is part of the Computer Science field (I am a computer science major) with respect to bus speed and data transfer (h.32x).

    I always kept a "low profile", until these slime-balls started trying to con me out of my property.

    Bottom line is, guilty or innocent, you don't have to turn anything over by law. If your intentions are honest, you need to fight and not hide.

    We have been looking into this since the first post. At this point, I can confirm that we (BrightShare, Jackpot Factory, Spiral Solutions) do not own this domain.
    We are trying to find out who does so we can demand they stop the pointing to BrightShare - this hurts BrightShare's SEO efforts.

    I hope to return in the next few days with some answers to this mystery.

    OMG! I am glad that you responded. I would check into WIPO policy. This is not only a violation of Microgaming's brand, but it is also violating your name as well. I wouldn't even no where to begin. You might want to contact Microgaming, if you have not already.

    why does bestmicrogamingcasinos.com share your server with brightshare.com ?

    if you do not own the domain why is it hosted on your server IMO this is very strange.

    No side-stepping.......

    As soon as this post went up, I went to our Operations, SEO and IT teams to figure out what was going on.
    After an in-depth check to confirm this site is, in fact, NOT owned by any part of our organization, our legal department tried to get in touch with Lexsynergy Ltd. - to demand they cut the redirect to brightshare.com.

    After receiving no response from them, our IT department went ahead and blocked the redirect from our side.

    End of story.......

    You have side stepped GCG's question: why does bestmicrogamingcasinos.com share a server with brightshare.com ?

    Brightshares ip adress: 64.34.230.144
    bestmicrogamingcasinos.com ip address: 64.34.230.144

    That means that both websites were hosted on the same server.

    I have also noted that bonusmicrogamingslots.com also redirects to brightshare.com, so I guess you'd better block that as well.

    Our www.brightshare.com is indeed 64.34.230.144

    Yet, anyone can direct their site domain in the DNS servers to refer to the same IP (even if their sites have nothing to do with us).

    As stated earlier, our IT department has already blocked, from our end, all traffic coming from this domain - bestmicrogamingcasinos.com - from reaching the BrightShare site.

    Re: bonusmicrogamingslots.com - we will now check on the infrastructure level to make sure only traffic coming from our own domain can reach brightshare.com - all other sites pointing to this IP will be blocked.
