EcoCard warns U.S. users?
I received the following email from Ecocard - it speaks for itself:
Quote:
Dear
IMPORTANT NOTICE FOR US LOCATED ECOCARD CUSTOMERS:
In response to recent publicity about the use of EcoCard for online gambling purposes EcoCard would like to draw its US located customers attention to the Terms of Service they have previously agreed to, and in particular, Section 8 – International Use, which clearly states;
8.1. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside. It is our assumption that international users are signing up for an EcoCard Account only after determining that opening and maintaining an EcoCard Account violates no laws or regulations in their respective country and jurisdiction. If you are an international user, you warrant that you are violating no law or regulation by your use of EcoCard, and you indemnify us for any and all liability that might arise from your use of the Service.
We thank you for your cooperation.
Best regards,
EcoCard Team

Yes, one of my members just posted this on our site.
The fact that it is in the terms is one thing...the fact that is getting emailed to US users...sends a whole other message to me.

They seem to be highlighting their disclaimer. I can only assume it is an effort to protect themselves. Hard to say what prompted this but it doesn't look promising.

Yeah, I agree Mojo.
Past experience with these online wallets...when you start to see bubbles on the surface, it's not to long before the water starts to boil!

Of course, that warranty is correct. A user of EcoCard is not violating any laws in the United States by using EcoCard. EcoCard might be violating the UIGEA, but the user of EcoCard is not violating UIGEA if EcoCard transfers money to an online gaming site on their behalf.

I haven't done any of the online payment processors since the Neteller debacle. I'm afraid that should to US push Eco, they may, on their own, deem certain folks as violating US law and withhold funds... I certainly wouldn't want to need an international lawsuit to recover my funds and I doubt US folks would want to class action a suit (many individual webmasters probably couldn't afford the legal fees)

I hate Ecocard! HOnestly I do. I receive payments for writing content from people through them and it took almost 3 weeks to get my money from them. Because I guess once you reach a certain threshhold they than want all ID and proof of bank, mailing address everything. I wouldnt have been as pissed if it wasnt for the fact that I couldnt get my money till after xmas. Anyway between that and ridiculous fees ...no thanks
