About LinkBacksOnline giant bwin lost a challenge to Portugal's sports-betting monopoly after a EU court said gambling restrictions are legal if they target fraud and crime.
Bwin had challenged Portugal’s national gambling monopoly and its extension to online wagering.
From Bloomberg:
The EU’s highest court said restrictions such as in Portugal may be justified to meet certain policy goals, including the fight against crime, as long as they aren’t discriminatory and don’t go beyond what is necessary to achieve their aim.
“The verdict is a major setback,” said Alfred Reisenberger, an analyst at CA Cheuvreuxin Vienna, who rates Bwin at “outperform,” said by telephone. “Bwin has lost a battle, not the entire war. They will continue to fight and in the long term they will be successful.”

This is bad news for the online gaming industry. It effectively allows any EU country to now ban online gambling and they won't be breaking any EU open community rules.

I think what they are saying is that play withthe goverment and there will no fraud ect....

Two related stories
Hi guys,
Two stories related to this came out of the CEO panel at last week's EIG that I thought you might be interested in. In the first, 888 and PartyGaming responded to the news with the view that B2B is a vital hedge against protectionism, while the panel also saw most top egaming CEOs agree that the shape of new law is the number one issue facing the industry.
