Removed them for having NCO in affiliate T&C, I assumed all Rivals did not have that ......so I did not read the T&C. My mistake.

No it's NOT your mistake - their terms DID say that they did not have NCO when you signed up.
They MEANT to say that they did, but forgot to change the T&C's when they went live.
They only corrected the error less than a week ago, but their attitude seems to be "tough shit".

I'm in communication with their management about changing their policy. The status right now is that the affiliate manager will be asking the owner to review some additional considerations that it appears the owner had not previously reviewed. I am hesitant to assess whether or not to be optimistic while the discussions are ongoing -- which is why I hadn't replied previously -- but I do want to note that we're working behind the scenes trying to get them to do the right thing here.

That is partially true. The terms and conditions themselves were silent on the issue of negative carryover (and still are), and the commission schedule that is incorporated by reference into the terms was also silent (and still is). The portion that was changed was in their FAQ page. For confirmation, Google cache still has the January version of these documents available (I have screenshots available if requested). However, there was certainly a promise being made by having it in the marketing literature (FAQ page) and not disclaimed in the terms. It would be more complicated if the two areas stated conflicting information, but in the case of marketing literature making the promise and the terms being silent on the subject.
