That's all fine until Google bans your website for link buying and then these type of T&Cs become really important

that is exactly why nobody should want to deal with these terms. Also imagine if you don't do link buying but your competitors buy links for you and you get penalized. You would possibly lose your commissions in this process and the affiliate program gets to keep your work and efforts.
