I already posted two unethical behavior reports in this forum: one about Club Gold Casino, and one about FlorijnCasino. In both cases, GPWA was not able to help. This is my 3rd attempt. After a long break from online gaming I chose a casino licensed by the Malta Gaming Authority (MGA), because I was recommended to do so, as the MGA license stands for quality. If you feel that I am right with my complaint, then please assist me against CosmikCasino and the Malta Gaming Authority.
HERE IS WHAT HAPPENED:
On February 24th, 2015, I made two 1000 Euro deposits into my CosmikCasino account. I asked the chat operator to remove all bonuses, so that I was able to play without any bonus wagering requirements. The chat operator confirmed to me that all bonuses were deactivated for my account, before I started to play. I played live blackjack and was able to win a total of 12000 Euro (twelvethousand).
I then submitted a 5000 Euro withdrawal request. The request was declined and my account balance was set back to the amount of my last deposit (1000 Euro). The casino accuses me of "irregular play": I should not have placed bets equal or greater than 30% of my deposit. I never heard of such a strange rule before. It is common practice, that casinos don't allow their players to place bets equal or greater than 30% of a given bonus. But as far as I know, players may always bet as much as they want from their own money, if they refused any bonuses. I wagered my own money (!), and the casino software allowed me to place any amount up to 500 Euro in live blackjack. So, if the software allows me to place bets greater than 30% of my deposit, then the casino MUST NOT void any winnings that I make. It clearly says "max 500 Euro" on their live blackjack table. It does not say "max 30% of your deposit". PLEASE NOTE: If you take a seat at any other casino (online or land-based), the table limit never depends on the amount of money which you have in your pocket.
I kindly ask the GPWA and its members to EVALUATE THE FAIRNESS of paragraph 103 ("Fradulent Activity and Irregular Play") in the T&Cs of CosmikCasino. The full paragraph is listed at: https://www.cosmikcasino.com/general-terms-conditions/?lang=en
Because I had played with my own money and without any bonuses, I request a refund of the full 12000 Euro, which I had won. If a player like me chooses to play without any bonuses and the table limit clearly says "max 500 Euro", then the only reason to set up a paragraph like paragraph 103 is to be able to void winnings, if a player is winning too much. No other online casino has such an unfair paragraph in their T&Cs. CosmikCasino should keep its license only, if it removes this paragraph and pays my 12000 Euro winnings.

Here is the controversial paragraph 103 in the T&Cs of CosmikCasino:
Paragraph 103: Conan Gaming reserves the right to withhold any withdrawals and/or confiscate all winnings and bonuses for irregular play. "Irregular play" may include, inter alia:
- Placing total bets equal to or greater than 30% of the value of the bonus credited to the player account, prior to the wager requirement for that bonus having been met.
- Placing total bets equal to or greater than 30% of the value of the deposit.

Here are 3 more important thoughts regarding this issue:
THOUGHT #1: When a player requests to play without bonuses, he may assume that he is free to play as he likes. He cannot be expected to read 103 paragraphs to search for a hidden term which says that he must not place bets equal or greater than 30% of his deposit value. The casino should clearly state on its home page AND on every blackjack table, if the maximum bet is limited to 30% of the deposit value. Just an example: If I go to a casino in Las Vegas and play at a blackjack table with table limit "500 dollar", nobody would tell me: "Hey, you may place 299 dollar bets only, because you only brought 1000 dollars into our casino." The live blackjack table at CosmikCasino had a clear sign on it saying that the table limit is "max 500 Euro". So, as a NO-BONUS player I must assume that I may place 500 Euro bets at this table, AND that I may split hands and double down this amount as I like.
THOUGHT #2: The controversial paragraph 103 in CosmikCasino's T&Cs talks of "irregular play" when "placing total bets equal to or greater than 30% of the value of the DEPOSIT". However, it is not stated what kind of deposit is meant. Is it the last deposit or all deposits made by the player? I had deposited a total of 3000 Euro into my account at CosmikCasino. Since paragraph 103 does not specify what kind of deposit is meant, I may also assume that I may place bets up to 30% of the value of my total deposit. In that case, there was no reason to void my 12000 Euro winnings, because the table limit of live blackjack (500 Euro) is lower than 900 Euro (30% of my total deposit).
THOUGHT #3: I strongly feel that ALL CASINOS licensed by the Malta Gaming Authority (MGA) should abandon rules like the controversial paragraph 103 in CosmikCasino's T&Cs. The MGA licence is a quality measure, but the only reason to incorporate paragraph 103 is to be able to void winnings from players who do not read all 103 paragraphs. The MGA should step in here and do its duty in regulating CosmikCasino, so that winning players are treated fairly. Once more: It was my own money, that I played with, and any other casino lets me play with my money as I like.
