    Arrow Online Gaming Portal Legal Disclaimers

    The Casino City website has tried to make sure over the years that it has had appropriate legal notices present in the footers of the pages of its websites.

    Back in the 1990's we had a legal notice that read:

    Copyright 1995-1998 Information Technology Systems, Inc. ALL RIGHTS RESERVED.
    Casino City is a trademark of Information Technology Systems, Inc.
    We updated this legal notice in 2000 to reflect the fact that site visitors should understand that there could be legal requirements around entering casinos, particularly in the context of online gaming becoming a more substantial part of the information provided on our various websites.

    Casino City is an independent directory and information service not affiliated with any casino.
    Copyright 1995-2000, CasinoPromote.com. ALL RIGHTS RESERVED.
    Casino City is a trademark of CasinoPromote.com. Please read our Disclaimer of Warranty

    Warning: You must ensure you meet all age and other regulatory requirements before entering a casino or placing a wager.
    Then, in conjunction with our filing a lawsuit against the DOJ in 2004 to assert our first amendment right to advertise online gaming, we conducted a more formal review of the legal notices we placed on the bottom of each of the pages of our website, and changed to the following statement based on the advise of our attorneys:

    Casino City is an independent directory and information service not affiliated with any casino. Warning: You must ensure you meet all age and other regulatory requirements before entering a Casino or placing a wager. There are hundreds of jurisdictions in the world with Internet access and hundreds of different games and gambling opportunities available on the Internet. YOU are responsible for determining if it is legal for YOU to play any particular games or place any particular wager.

    Terms of Use Privacy Policy Copyright 1995-2004 Casino City, Inc. or its affiliates.
    This is the legal statement we have published to this day.

    However, based on comments I have seen in the past few days, I've come to decide it is appropriate to make another update to our legal footer. A decade ago when the sentence "Casino City is an independent directory and information service not affiliated with any casino." was included in our legal footer the term "affiliate" had not taken on the meaning it has in the affiliate marketplace today.

    Then, as well as today, the term "affiliate" has a specific legal definition normally applicable when used within legal documents.

    1. A company that owns a minority interest in another company. This gives the first company a degree of control over the second, but not enough to make it a full-fledged subsidiary.
    2. One of two companies that have a structural relationship with each other. For example, both companies may be subsidiaries of the same parent company.


    However, the issue pointed out to me is that now the term "affiliate" has a common meaning that is different than the legal definition outlined above. Today it is commonly used to refer to someone that has entered into an affiliate marketing relationship. By that newer definition Casino City, and virtually every gaming portal site, is an affiliate of one or more casinos.

    Normally this would just be a situation where I would simply make an appropriate change on sites I control, but Casino City is frequently used as an example of best practices by other webmasters. So I feel an obligation to let as many folks as possible know of the issue I now see with this wording, particularly those who might have relied on Casino City as an example to follow. My hope is that other webmasters will make appropriate changes to their websites as well.

    There are quite a few such sites. Searching using Google for the phrase "independent directory and information service not affiliated with any casino" -"casino city" turns up 7,690 search results.

    The new wording we have adopted in place of "Casino City is an independent directory and information service not affiliated with any casino" is simply "Casino City is an independent directory and information service free of any gaming operator's control."

    Google shows hundreds of sites using the old phrase, even funier is that there are already sites using the new phrase.
