    Default US Responds to iMEGA in Online Gambling Legal Suit

    Today, Casino Gambling Web came across the USDJ's written response and the arguments are much the same as they were in their initial filing for a dismissal.

    The new documents state that the members in iMEGA's suit have not been harmed specifically by the passing of the UIGEA. They also state that the iMEGA members, if they are breaking laws presented in the UIGEA, are not acts of free speech, but rather acts of conduct that may or may not be pursued by prosecution. The USDJ also states that no member is currently being prosecuted, as well there is no reason to fear prosecution, therefore iMEGA has no grounds to further pursue a TRO against the UIGEA.

    According to CardPlayer, oral arguments in the case will begin Wednesday. It will be interesting to see how this all plays out.

    Indeed. The grounds are that the UIEGA is unconstitutional which is a lot to take on. Definately worth watching.

    I think I will find the next convention of u.s. attorneys set up a booth and start demonstrating online casinos. Let people open accounts right in front of their eyes.

    The initial hearing was today, and according to an AP story, the judge expects to rule on the case within 30 days.

    Since the USDJ have a position that they are not even thinking about prosecuting any affiliate. I say we turn up the heat.
    I am willing to promote Internet casino gambling directly in public at some place (undecided as of yet) directly in their faces . I was thinking about adjacent to a federal court house in Southern California.
    I will take a large box truck and set it with a large screen T.V . Park in a place where U.S. Attorneys frequent at lunch time. Use a sound amplification device. Start hawking to have people try out a "willing casinos" software. Actually sign-up people for accounts.
    I need a casino willing to let me promote them in what will be a difficult battle. I am A very in your face type of person. I know how to be confrontational and draw a response from people.
    All of this will be recorded. I will of course scope out my prey before starting(check out U.S. Attorneys and where they eat lunch).
    Please if you have a casino that I can promote in this manner let me know. I want to provoke a prosecution. This matter needs to be settled by the U.S. Supreme Court.
    This is a true test of the Justice Dept. Commitment to the UIGEA.

    Did anyone notice this - in the AP story about the iMEGA hearing that Buzz posted yesterday.

    News to me

    This looks like the same deal - establishing a law by insistence - that the IRS perpetuates with Income Tax. If you don't want to go through the drag of making it legal, iterate as many times as you like that the law exists and you establish a belief system.

    They did not say they would not prosecute affiliates, they said they would not prosecute bettors.

    I believe (this is just from memory) They stated the their members should not have any fear at the present. wE ARE NOT CURRENTLY PROSECUNG ANY AFFILIATES OR PLAN TO PROSECUTE ANY IN THE NEAR FUTURE.
    I will go back and check the eact quote from their brief. The spirit of their posistion sounded as if they the freedom of speach issue was mute because they had no plans of prosecuting affiliates at this time.
    This is the point that i want to press. The Freedom of speach. This is a freedom that is going down the slippery slope of being of govertment censorship.
    I have to agree with the part of their brief that the fear of prosecution point is not ripe as of this point. I WANT TO CHANGE THAT . I truly believe i can provoke a prosecution. This will open the door for a possible court of appeals decision and eventuly a supreme court decision . In california i believe we have the best chance of a decision with the 9th circuit court of appeals.
    I need support. I truly believe this can put internet gambling on a fast track for the Federal Government to understand that "all forms of gambling" are a "states rights" issue and for them to stay out of this areana.
    Please if you can set me up with a willing online casino it will be aoppreciated. I am sure this will generate media exposure. Hopefully world wide. r
    Remember I am the one that will be arrested prosecuted and facing what could be a lengthy federal prison term.
