    Exclamation España cierra los programas de afiliación de casinos

    Hola a todos!
    Para aquellos afiliados que trabajan con casinos legales de España, les traigo malas noticias.
    A partir del 1 de mayo de 2021, cualquier promoción de captación de jugadores queda prohibida. En cuanto a las promociones de fidelización, sólo podrán comunicarse dentro de la web del operador de casino o a su propia cartera de clientes. Por todo ello, los afiliados no podrán comunicar promociones de captación ni de retención a partir de esa fecha.
    Como veis es un duro revés en la política del juego de azar online del gobierno español. ¡Vamos España, más restricciones, más gilipolleces!

    Sí, la regulación de la publicidad del juego en España (enlace a un análisis que hicimos) fue aprobada el 3 de noviembre pasado.

    Ya hemos empezado a recibir comunicados de parte de sitios pidiendo eliminar cierto contenido, entre ellos cualquier referencia a personalidades, bonos de bienvenida, promociones, y demás. Consideramos que es un gran revés también un país donde según las estadísticas que proporciona el ente regulador están controlados.

    En nuestro caso no nos han pedido eliminar la reseña, ni han cerrado el programa de afiliaciones, pero si han pedido adaptar de manera urgente toda la web para quedar en cumplimiento legal.

    También está pasando con sitios que operan en Estados Unidos, quienes se conecten desde ciertos estados no pueden ver algunas ofertas.

    Does anyone have a clear list of what rules an affiliate needs to follow on their website? We are getting a lot of mixed messages from operators

    However, even there the rules aren't that clear, and nowhere you will find like an "affiliate checklist" so it's normal that operators are asking for different things each other. They may also want to take advantage of the changes to modify their programs and pay less to affis.

    Thanks for this, we've been through the official document but so much of it when it comes to affiliates is vague. I was hoping someone had a sensible do and don't list.

    Hi everyone!
    What the new regulation says is that you are allowed to capture new players only through the casino operator's website and advertise only to the existing player base. In other words, goodbye affiliates!
    And logically, all operators that are licensed in Spain are going to change their terms and conditions.
    The truth is a disgrace and total disaster the current Spanish politicians. From many years that I live in Spain, I have not yet seen the worst and useless politicians like now! The government of former school teacher Pedro Sanchez is the worst rated in history.
    Too bad that the operators who have paid for the license are now cheated in this way. It is a bad image of Spain that in the future will damage the country even more.
    In my personal opinion we should forget about the Spanish market for a long time and look for other horizons.

    In reviewing the text of the Law again I have found some interesting information.

    Original:

    "Artículo 23. Comunicaciones comerciales en servicios de la sociedad de la información.
    1. Queda prohibida la difusión de comunicaciones comerciales de los operadores de juego en servicios de la sociedad de la información, salvo en los siguientes supuestos:

    b) Cuando se emplacen en páginas web o aplicaciones cuya actividad principal sea la oferta de productos o información sobre las actividades de juego definidas por la Ley 13/2011, de 27 de mayo, siempre y cuando estas páginas web o aplicaciones cuenten con mecanismos para evitar el acceso de menores de edad y difundan, de manera periódica, mensajes sobre juego seguro. A estos efectos, los servicios de intercambio de vídeos a través de plataforma y las redes sociales no se consideran páginas web o aplicaciones de las previstas en este párrafo.

    Translation:

    1. The dissemination of commercial communications of gaming operators in information society services is prohibited, except in the following cases:

For these purposes, video sharing services through platforms and social networks are not considered websites or applications as provided for in this paragraph.


    This can be interpreted as the possibility to continue advertising, but applying the affiliate's website has to apply all the mechanisms and strict measures to protect minors so as not to harm the operator and its own website.
    My question; is it worth doing all this for a pittance of commissions offered by Spanish operators?
    Let each affiliate draw his own conclusion.

    I have not seen affiliates shutting down due to the new regulation. They are adapting their websites to the requirements and following all the crazy recommendations from the poker rooms. I'm talking about the market I have experience on.

    Does it worth it? Well I think yes, for some that have been long-time stablished on the Spanish market and that's their core, but for affiliates operating in several countries and just serving Spain as another more, the answer would be probably no.

    I have not been closed so far from any of the online casinos in Spain. But I have received numerous notices to remove advertising material.
    Things are getting very interesting. Bullshit is becoming fashionable in Spain!

    Es una locura las diferentes indicaciones por parte de los operadores. Cada uno entiende la ley de una manera. Me han dicho por un lado que puedo presentar las promociones del operador, por otro lado que necesito obligatoriamente un popup de ¿Eres mayor de 18? (Menuda idiotez).

    Yo me leo el BOE y entiendo que puedo publicar todas las promociones que existan si mi web es exclusivamente de juego y tengo algo para que no entren los menores. Lo que no se puede es presentar promociones de bienvenida, pero es que no las hay. El problema es que una cosas es leer el BOE y otra entenderlo correctamente, sobre todo para alguien de ciencias.

    Entiendo que lo de mayor de 18 años irá mas enfocado hacia un tag html que entiendan los buscadores y herramientas de "parental advisory". ¿No es así?

    También nos han pedido el pop-up para validar la edad. Todo tiene que ve con la interpretación de la norma, promociones de bienvenida ya no hay, entonces pues es tonto que pidan que no se promocione algo que no existe xD. Luego igual como afiliados no nos queda otra que hacer lo que pidan los operadores por tonto que parezca, igual no perderán chance de librarse de algunos afiliados que les estorben.

    No creo que vaya a un tag html sino a la confirmación como tal de la persona, algo como un traspaso de responsabilidad, como hacen las páginas de licores por ejemplo donde tienes que meter tu fecha de nacimiento.

    Y si..todo lo que están comentando, amigos, es cierto. Lógicamente, hay que entender también a los operadores de casinos que han pagado por la licencias y ahora el gobierno de Sánchez le esta poniendo por detrás sin vaselina. Habrá muchos "despidos" de afiliados. Pero no hay que lamentarse, no es fin del mundo, encontraremos otros horizontes. Hay miles nuevos casinos en línea que quieren crecer. En mi experiencia, veo que grandes marcas con el tiempo empiezan a despreciar a los afiliados. El claro ejemplo de bet365 y otros. Por lo tanto hay que mandarlos a la mierda, **** y buscar otros socios. Porque al fin y a cabo, hay que mantener la postura donde los operadores de casinos dependenden de los afiliados y no al revés.

    Lamentablemente en algunos segmentos (como el poker) o mercados muy regulados (como España) ha cambiado mucho eso, y los casinos simplemente se dan el lujo de patear a los afiliados sin muchas consecuencias

    We got it too, but after reaching the affiliate manager he explained that we needed to make some changes to the site and they'll revert the decision.

    bonuscodes will need to rebrand the codes and any supplementary text that makes reference to being able to claim bonuses.

    Básicamente mi duda es:

    ¿Puedo tener una página que ponga "codigo bonus bet365" y hable de que es un codigo, como se utiliza y poco mas, sin incluir ofertas ni enlaces?

    O lo de "rebrand" significa que hay que cambiar totalmente el contenido sin mencionar codigos de alta.

    Have you talked to your Bet365 Affiliate Manager?

    While you may get suggestions from other affiliates, questioning a specific term of Bet365, having a direct answer from Bet365 seems far more logical, and certainly the safest way to get an accurate answer.
