Default Judge Rules: Wire Act Only Applies to Sports Betting

The federal judge in the New Hampshire case against the Department of Justice has ruled that the Wire Act only applies to sports betting. In doing so, he set aside the Justice Department opinion that the act applies to online gambling and poker, which some feared could put states in danger of losing their online lotteries and regulated Internet betting.

On Monday, Judge Barbadoro said New Hampshire had the standing to sue and that the Wire Act was limited to sports gambling. New Jersey also has pending legal action against the Justice Department over their Freedom of Information Act request for documents tied to the agencies changing opinion on the matter… documents which could tie the decision to Las Vegas Sands CEO Sheldon Adelson.

So what does this mean for the future of online poker in the US?

Another 2 or 3 decades and a majority of the 50 states will become regulated and band together to form a network. Right about the time AI takes over the world.

It's sort of hard to say for sure, but it has to be good news overall.

The judge in this case has said that he does not believe he has the authority to issue a ruling that will apply to any other states... just to New Hampshire. But he did say that New Hampshire can sue the Justice Department for any harm caused by their change of opinion. So, it looks like other states will have to file their own lawsuits against the DOJ to extract their pound of flesh.

If the DOJ decides to continue this fight, it could drag on for a long long time and end up in the Supreme Court. If the DOJ believes this sets a bad precedent and is concerned about lawsuits and liabilities in the future, then perhaps they back off. It's really hard to guess, as they do not usually follow logic.

What I always believed would happen is that they would lose the case, then more and more states would regulate sports betting, and that ultimately sports betting regulation would lead to more online gambling and poker regulation. With a ruling on the Wire Act now in the books, I believe that even more strongly now... even if it's only intrastate for now.
