    Default What affiliates need to know about New Jersey's policies

    Interesting article but it seems to me that they missed the most important thing that is the hulking pink elephant in the room.

    New Jersey DGE keep using the word "illegal". Seeing as we all know that the justice department specifically stated that the Wire Act does not apply to online poker or casino games, then I'd be very interested in hearing the New Jersey definition of "any illegal online gaming sites accepting wagers from players in the United States". Because not once have I ever read or heard a clear definition of an "illegal online gaming site" as it pertains to the whole of the USA.

    I can only assume that it does not exist.

    If they mean "non-licensed" then that is what they should say. Because quite clearly despite the FUD and misinformation campaigns of many politicians, online gambling is not illegal at all under US Federal law and it is up to individual states to determine its legality within their borders.

    If they were to publicise a definitive list of US states where online gambling is illegal, that would make things far easier for everyone to comply with.

    I agree it should be defined as non- licensed but in the end I don't think it matters. At this moment it's not illegal.

    The way I read it is that since NJ has legalized online gambling within their borders and you have not gone through their stringent process then you are illegal in their eyes. I believe that state laws will trump the ambiguous Wire Act and perhaps not be a Federal issue. If their isn't a specific law spelling that out then there will be one created as states will not allow unapproved sites. It's about the tax dollar and they won't mess around IMO. I foresee a hard approach and precedent setting prosecution or two for 'illegal' sites. On whatever grounds they come up with.

    As far as the rest of the country sure, you can still target the unregulated states. However as they roll out regulation one at a time we'll be faced with the same thing. And you already have a strike against you from NJ.

    Much as I try I can't find a middle ground. Then of course there is RAWA.

    If one clicks the link and reads, they have defined what they consider "illegal online gaming sites".

    "An illegal gaming site is one that is not approved or licensed to accept online wagers from customers located in New Jersey or in any other state"

    Anybody explain me, what is this:
    Submit a notarized Certification from the CEO or COO to the DGE “attesting to that fact.”
    I am not a citizen of the USA. Last time i visited USA 23 years ago (3 week).
    So where i may find this "Certification" and notarized them?

    I have clicked and read it. What they may "consider illegal" is irrelevant if it is not actually illegal though is it? Compliance within New Jersey is one thing, but threatening licensed entities that refer people from other states where online gambling is neither regulated nor illegal is nonsensical.
