Default Luck Jar Affiliates - Account closure on the back of UKGC fine!

    Thursday 29th November 2018

    Dear David (id:252),

Termination of Appointment to LuckyJar Affiliate Program

We are writing to you in relation to David Xxxxxxxxx's (“you; your”) appointment as a member of the LuckyJar Affiliate Program (the “Affiliate Program”) operated by Daub Alderney Ltd (“Daub Alderney; we; us”).

As you will be aware, the terms of your participation in the Affiliate Program are governed by our Affiliate Program Agreement (the “Program Agreement”), a copy of which is attached to this letter. You agreed to the terms of the Program Agreement as a condition of your participation in the Affiliate Program.

In accordance with clause 9.3 of the Program Agreement, we hereby terminate your appointment as a member of the Affiliate Program with immediate effect.

We wish to draw your attention to your obligations under clause 9 of the Program Agreement. This stipulates that, following termination of the Program Agreement:

    1. you shall immediately stop promoting our services and all rights and licences granted to you under the Program Agreement will terminate immediately;

    2. you shall return to us (or, at our option, destroy) any and all materials (including all marketing materials), supplied to you in connection with the Program Agreement or over which we have a proprietary right, that are in your possession or control and/or the possession or control of your agents, servants, directors, employees or sub-contractors; and

    3. you shall immediately remove any hyperlinks and materials relating to any of our brands (including without limitation LuckyJar, Kitty Bingo, Lucky Pants Bingo, Bingo Extra, Spin And Win, Magical Vegas, Lucky VIP, Regal Wins Give Back Bingo, King Jack Casino and Aspers) including all references to such brands and use of any brand names, logos or other trade marks, from your website(s) and/or the websites of your agents or sub-contractors.

Please acknowledge receipt of this letter and confirm your commitment to comply with the requirements contained in it.

    Yours sincerely,

Matthew Maunder – Affiliate Account Manager
    Matt@LuckyJar.com

For and on behalf of Daub Alderney Ltd

    --------

FYI clause 9.3 is as follows:

9.3 We may terminate this Agreement (including all Promotion Rights) immediately, with or
without cause at any time, upon written notice to you, which we may send by email to such
email address as you have provided to us. We have the right to cancel Promotion Rights with
immediate effect if you are in material breach of this Agreement. Such breach includes, but is
not limited to, situations when you engage in advertising, marketing, distribution and
promotional efforts that would tend to impair or harm our goodwill and business reputation
and/or would or might expose us to any legal liability. In the event we cancel your Promotion
Rights, we shall be entitled to disable your tracking code(s) with immediate effect.

I don't promote to the UK, EU, or AU. All these countries are blocked using Maxmind DB's (both IVP4 and IVP6). Put simply, they give no reason for the closure, only the vague ones mentioned. Instead they've just terminated my agreement, end of story.

Sure, I'll reply, wont guarantee it will be a nice response though...

The way I understand it is that this same letter went to a very long list of affiliates.

They are currently still allowing affiliates to sign up a their site.

We have not received such a letter, so this list (at least for now) has stopped somewhere.

Nor me. Is it directed at certain affiliates, or countries?

Dave, have you sent them any NDP this year or recently? Could they be going after quotas?

Its investigation reviewed the accounts of three customers that showed potential signs of problem gambling, but did not trigger any action from Casumo.

    Wait a second,
    how does it work?

The player lose cash, and fill a complaint to ukgc ?
Did we live on the same earth, something is going wrong here...

    Yes.

Or employees or banks file a complaint because money is stolen from them.

In the case of Casumo, they didn't even meet formal requirements, like having a risk assessment. That triggers UKGC.

But the mails to affiliates like in the OP are bs excuses from programs to steal.

    They're not on site anymore.

When the IGA (AU gambling ban came into force, August 2017), I immediately closed my .com.au site, another .com I had become the main site. At that stage, I blocked UK, EU and AU traffic. And, I only ever targeted US traffic before the UIGEA. So that market wasn't in the mix either.

However, I didn't reinstate any Luck Jar casinos.

I'm aware of a few casinos which left the AU market, were conducting clandestine agreements, in which AU players were sent to other casinos still accepting those players. And, just like what took place in other exited markets, I, and others, didn't see a red cent from those unethical deals.

So in answer to your question, more than likely, the truth (excuse to steal income and players) is a min quota BS.

Worse, they have the audacity to refer to the T&C's, as if 9.3 clause is equitable. I highly doubt any Magistrate or court in the UK, AU or Alderney would allow such a one-sided-contract clause to govern, let alone give rightful credence to stealing, which is what this is... white collar crime.

Anyway can't do much about it, aside from let affiliates know what's going on

You can't just go around slandering a fine company's name because you have done wrong. Lucky Jar are one of the good guys out there. Probably one of the best around. I'm sure no matter what has happened, it is your fault.

Dave, was your account still generating any legacy income/activity? Not defending what's happened at all, just trying to see the whole picture.

Non performing affiliates really do NOT cost an affiliate program funds, they are just spots in the database. (emailed newsletters going to a list of email addresses queried from the database, even follow-up emails requesting more traffic etc to an email list queried from the database, the costs do not really change in any significant manner)

Personal follow-up from affiliate managers, yes, but that will mostly be done with affiliates that are producing.

Affiliates that recommend against joining a program can con cost them a boatload.

That's a fair question FictionNet... In answer, no.

Frankly it's no skin off my nose.

However, others, who maybe still be earning, but not sending players for whatever reason, using a vague clause to terminate an aff account, is what I, and I'm sure many would view as unethical. Hence, I commenced this thread to let others member know what's being circulated.

I've done nothing wrong except remove them from my site. The UKGC slapped them with a £7.1m fine...nuff said!

We thought it would be appropriate for Lucky Jar Affiliatesto respond here to provide further information regarding the account suspensionemail sent to a selection of affiliates.

Due to the latest regulation updateand to limit risk as a business in terms of compliance, a decision was made toclose accounts that were deemed to be inactive, the following criteria was usedwhen making this decision:

Sixmonths without logging into the Lucky Jar platform
    Sixmonths with no FTDs
Sixmonths with less than 10 registrations

Emails were sent to those who fulfilled some or all theabove criteria, in cases where affiliate partners have more than one account, one of which is not in use, then we are open to come to an agreement on anyaccounts which are active.

Due to the nature of such a decision, the accounts have beensuspended before closing allowing those to still have access to their accountsand any information they hold.

We hope the above provides some insight into our decision.

    Kind Regards

    Matthew Maunder

I'll guess the compliance relates to the ongoing updates issued by the UKGC (and possibly includes MGA too)?

However, both are moot points if those affected by this cull are not promoting to the UK/EU, &/or have both regions blocked.

Reiterating, it doesn't affect me either way, cause 1/. I've removed the casinos from my sites. And, 2/. I have no ongoing residual income generated from past referred players.

But, what about affiliates who fall into a similar (identical) situation as myself. Where, they have sent Lucky Jar players, and these players continues to earn affiliates commission?

NB - Full Cream affiliates took the decision to close non-complaint-accounts. However, they continued to pay affiliates for players previously tagged, before the 'latest' set of rules came into force.

Handling this any other way, is stealing the rightful commissions of affiliates affected by this cull!

Oh do behave. Come on, just admit that you have jumped on the "Sky Vegas" bandwagon, and found a nice little earner thieving commission off your affiliates.

You closed my account several months ago. I was sending at least 20 to 30 depositors a month. My sites are more than compliant. I know this as they have been verified by several big brands, who are all more than happy with them.

You have also ignored several emails about the situation. Don't try and dress this up with "compliance issues" you are nothing more than thieves. You are no better than people who go around burgling people's houses. That is the sad truth for you.

Records in a database do not cost any money. Non-compliancy risks can be perfectly mitigated by closing just the links of those accounts and keep on paying.

What Lucky Jar does is just stealing. It seems that that UKGC was a little harder hit than they expected. Another rogue outfit.
