Account Terminated - Remove All Content???

Does anyone else find it strange that when an account terminates your account you are given a warning to remove all references to the casino or affiliate program from your site? They will even quote a clause in the T&C's.

If you no longer have an account (agreement) then there is not contract or obligation to remove content?

I'm guessing what they really mean is any content (banners, images etc) which were supplied by the program for your use, but you're not the 'owner' of. It's theirs.

3) Modify the review, in a negative way, including their demands I remove content
4) Spend more money than I did actively promoting them, while working with them, to rank reviews for them, in a negative tone instead

I don't tolerate ****** operators. I let the world know they exist. Because ultimately, I don't need the money, this business is for my satisfaction as a human being. And ultimately, I find that calling out the wicked is more satisfactory than making an extra 5% per month or whatever.

The programs have all the power with their 'agreements', when they terminate these or add horrendous quotas and clauses one of the only things we have as affs is our own content, it is ours and they can't tell us what to do with it (as long as it is not defamatory or false). Yes I will remove banners and links but otherwise the reviews and listings are mine to do what I want with.

I've had dozens of requests to take content down after brands have pulled the plug and each time the answer is 'screw you'.

ARTICLE 7 - Termination

7.1 This Agreement may be terminated by either party by giving a seven (7) day written notification to the other party. Written notification may be given by an email.

7.2 The Contracting Parties hereby agree that on termination of this Agreement

a. The Affiliate must remove all references to bet3000 .com from the Affiliate's websites and/or other marketing channel and communications, irrespective of whether the communications are commercial or otherwise.

b. All rights and licenses granted to the Affiliate under this Agreement shall immediately terminate and all rights shall revert to the respective licensors, and the Affiliate will cease the use of any trademarks, service marks, logos and other designations vested in the Company

c. The Affiliate will be entitled only to those earned and unpaid commissions as of the effective date of termination; however provided, the Company may withhold the Affiliate's final payment for a reasonable time to ensure that the correct amount is paid. The Affiliate will not be eligible to earn or receive commissions after this date.

d. If this Agreement is terminated by the Company on the basis of the Affiliate's breach, the Company shall be entitled to withhold the Affiliate earned but unpaid commissions as of the termination date as collateral for any claim arising from such breach. It is further specified that termination by the Company due to a breach by the Affiliate of any of the clauses in this Agreement shall not require a notice period and such termination shall have immediate effect upon simple notification by the Company to the Affiliate.

e. The Affiliate must return to the Company any and all confidential information (and all copies and derivations thereof) in the Affiliate's possession, custody and control.

f. The Affiliate will release the Company from all obligations and liabilities occurring or arising after the date of such termination, except with respect to those obligations that by their nature are designed to survive termination. Termination will not relieve the Affiliate from any liability arising from any breach of this Agreement, which occurred prior to termination and/or to any liability arising from any breach of confidential information even if the breach arises at any time following the termination of this Agreement. The Affiliate's obligation of Confidentiality towards the Company and IBA Entertainment shall survive the termination of this Agreement.

I can’t stand programs that decide to pull the plug on any of their affiliates, especially programs that you've been in loyal partnership with for many years (some even stretching 10 years or so). It really annoys me how they just mess with us as they want. What also really bothers me is that there are no prior warnings to try to work out any issues to continue working together before the closure notice is sent out. They should at least listen to you and give you a chance to be heard, considering the fact that you've been with them for a long time. It's very unfair and it hurts. But then again, there's nothing fair in this crumbling world.

I was once contacted by police to remove the content, after I told them to fo. No joke.
Just some policeman from completely different jurisdiction politely asked me to remove a banner and mildly threatened me that he will give it to my local police.

So this is what the police is for if you are not sure. And this is what the KYC is for.

I agree. We did respond wanting to work with them and/or at least to promote their affiliate program but no response. This seems to be very common.

So, rather than trying to work together links and ratings for both casino and affiliate program have been adjusted. Who wants to promote programs that behave like this anyways. More their loss than ours.

There is such thing as fair usage of trademarks. Under fair usage I guess they cannot make you legally take down their trademarks. Especially if when their trademarks were used by you, you were technically licensed to do so. I would ask for a takedown fee. One or two casinos have asked me to take down their images, I simply ignored them. No point in acknowledging that you seen their request.

However, and TBH, with all the BS of scammy-Admin fees and other less than ethical (verging on criminal) antics by some operators/programs, I'm now seriously geared towards getting Ventit.org up and operational. And use that to kick these bastards back, hard!

Or, perhaps just a routine rebooting your web server it the middle of the night would fulfill your contractual obligations. I think telling them you have done that, and therefore met your contractual obligations, is what I would choose to do.

Personally, I strike terms like the ones you have mentioned before accepting any agreement, or specifically add a new provision stipulating fair use rights apply notwithstanding any other contract terms. Typically, I also require signing of a supplemental agreement that stipulate that U.S. laws apply, and U.S. laws include clear fair use provisions.

This is a nice theory that exists in the parallel universe.

In this universe we are robbed from left and right.

1. You are told that they terminate "lifetime" revenue deal, whenever they like
2. You refuse and go to lawyers
3. They insist on taking down the material, so they will have another excuse to shut down the account because you "do not promote them"

I think when we find retarded operators like this, we should all band together and write stories about the infraction. Interlink the articles together, and point them all back to the website who originally experienced the attack.

In this way, we could EASILY rank negative stories about crappy operators, share link juice among ourselves (the main story would have a thanks section that linked back to other websites picking up the story), inform players and other affiliates about crappy operators, cause the crappy operators to lose business due to negative articles in Google, and ultimately, teach other operators NOT to **** with our community.

In fact, LCB has done this in years past and I contributed to that effort, as did a number of other GPWA'ers. Like that time Burnbet sent them death threats:

A group of us did this with 888 (circa 2009). Webzcas and I spearheaded another 'name and shame' against the 2012 WP hacker, where, it turned out, all roads led back to Wagershare and their SEO company Wintechnologies.net. When this info was made public across multiple affiliate sites, literally, within 48 hours, ALL WP hacked sites were clean and no instances of hacks existed.

Thing is though, once one commits to being involved, then one needs to keep being involved and not slacking off. I've found most of these type of initiatives, unfortunately lose their momentum after 3 or so weeks. Hence, reiterating, once involved you stay involved and give it your all...

This is the correct response. No-one but you controls what you publish on your own website. Tell them to go get stuffed. And if for some weird reason you feel conflicted doing so, maybe have a think about whether you would rather be a "partner" or "promoter" of affiliate programs vs a partner of the players who read what you write.
