Default All Sports Affiliate Managers - Stolen/Copied Content

What is your stance on this? I have found at least 4 sites ripping my content off and you are all working with them. I know you can't check these things out and I wouldn't expect you to bother checking but is it against your policies once it brought to your attention?

If you'd like to get on these arseholes backs and help me get them to stop stealing my work reply to the thread and i'll PM details.

I know about getting copyright material removed and have set the ball rolling but it can be slow and frustrating so covering all bases

Well then, why bring it up?

After looking at your evidence, I agree it is a clear case, but will let it up to you as to whether anyone else is told.

it's up to the affiliate managers to do anything about it if they want to, if it isn't something they are worried about that's up to them, hence why I asked them if it's against there policies

thought the first post clarified that

We we care about copying of content, and like I had said, you had a clear case of word-for-word copying.

It's normal to see copying of content that is put out by the programs since some affiliates do not fully understand that the marketing material is meant to be a guide to be used to write their own stuff, but when cases such as you showed me today are found, (and in your case this was material unique to your site and created by you) it's good to know about them so we can all help each other watch out for such cases, and help with reporting etc where necessary or requested.

I wouldn't put the links out in public as basically don't want to give them a free link or the chance of people linking to them later on

That is a valid point and why we will often obsfucate the http or mess up the top-level with an underscore or such in order not to allow any link benefit.

Most affiliate programs do not have a specific term regarding the intellectual property of other affiliates. However, most do have a general term about not engaging in any behavior that would be detrimental to the brand (good will term). Violating intellectual property laws in conjunction with promoting the brand could be seen as in violation of the good will term.

In the case where a clear and obvious case can be made for the stolen content, it should be feasible for an affiliate manager to contact the offending affiliate and have them remove the stolen content.

I've personally done this numerous times for affiliates, and am happy to do this on behalf of any managed Income Access brand.

I'm absolutely with Louis on this issue and we would see the 'good will' terms in our T&C's as being most applicable here. I'd def be willing to take the issue on if an affiliate contacted us and was able to show us that the content had been originated by them and then ripped off to appear on somewhere else.

I'd help you out with the AM contacts if I knew the rest of them but I only have details for the teams at Victors, Fred's and SkyBet which you've already mentioned.

Its good to see Affiliate Managers take stolen content seriously. Just out of interest what would be the best way to demonstrate its your content in the first place?

In the past, where whole pages were copied, the affiliate was able to demonstrate that the original content was lifted from his site by changing images since the copier had not bothered to host his own images.

In Thebookiesoffers' case, it is a bit trickier because the only thing that was lifted was text. I'm researching the best way to prove who was the original source for the content. Will post as soon as I find something.

My thought is that perhaps you can use http://web.archive.org to demonstrate that the content was on Thebookiesoffers.co.uk before being on the offending site. When I did an analysis just now, the content you have is on your site as early as January and before, whereas there are no archives for the offending site before March.

My question to the forum is, if there are no archives on Archive.org before a certain date, does this mean that the site was only published on this date, or are there other factors that might affect what is available on Archive.org?

Archive.org only crawls from time to time. It's great for looking at old versions of pages but misses a lot of content updates and seems to update sporadically. I would not take the first archive.org page date as being when the site was launched.

Yea, sadly the archive does NOT upodate like it used to.

I know this makes it tricky, I know Bookieoffers is telling the truth in this case, but to come up with a difinitive answer as to how to guarantee future cases case be proven or disproven is quite a tricky thing indeed.

In cases where the site is a blog that webmasters are dating their publish dates, this will sometimes be an indication.
You can also look at domain creation dates as sometimes this will be an indication....(IE: if a site is only 6 months old and the original content has been up a year, it's a good indicator)

This could end up being an interesting discussion.

I would like to hear more thoughts on this also.
