I cant answer legally... But if I didn't request email from you specifically, then I consider it spam.
1 unsolicited email to several people, for the internet rules is spam.
For some registrars, only one email is a reason to start an investigation before the ban of the domain name .
Anyway, daily I receive some emails that I don't consider spam at all.
Some polite link request, some SEO offer etc.
After all in the offline life , mail business letters, unexpected vendors etc. is a daily matter.
Have these people said loud and clear that they want to receive exactly the type of mail you send?
Did they opt in?
Do you have a working opt-out function? Is it easy to use and instant?
Do you give your snail mail address in your email?
These are all legal requirements.
Smart newsletters have a double opt-in these days, firstly people have to opt in by signing up for it, and then they have to reply to a confirmation mail.
That may cut down in the number of recipients, but they will all be wanting to hear what you have to say and will be happy customers.
That "source" line is revealing.

That means purchasing or exchanging email addresses and using them to send messages to recipents that did not opt-in to receive stuff from you.

In my understanding, they must opt-in to your site or program so they are aware exactly what you as the provider are giving them.
You cannot "buy" even opt-in emails, no matter how good a source they are from unless you want to be labeled a spammer and take the possible conseqences!
luckily i have had the list for 3 years and havent used it as yet.... i was cc an email with 30,000 email in error from a stockbroker with all their clients,,,lol printed it and kept it just in case, but in hindsight wont be using it.

That would definitely be illegal.
Illegal and hated by most. What you should be doing is burning the list just in case. Sure wouldn't want to be caught with a third party email list.but in hindsight wont be using it

If you see on other gambling websites "Contact us" link and send them link exchange offers or other gambling related requests (such as ad, articles offers and etc) you won't be a spammer. Of course if you send them the information that is not gambling related as for me it will be spam.
I am a newcomer, was going to post in the intro page when I came across this first. I recieve an email from a particular individual in both my personal account and my affiliate account. These emails always say garbage like $75 free at this room please reply for more information, or want to go to the WSOP have I got news for you. They are poorly done attempts at an ad. Anyway I have never given this person consent to email me, I have also told him once they started hitting my affiliate account to stop to which he does not. I recieved another yesterday and laid it into him explaining that the way he markets is considered spam, that I have made repeated attempts to eliminate his garbage and even the possibilty of cntacting the room to which he promotes. HIs reply was my email address can be found all over the internet so if I don't liek it don't read it.
The point is yes I can move it to my junk folder however I do not want garbage, I did not subscribe to his junk so why should I tolerate it, especially when his tactics are dirty.
Further,my affiliate email account is not just flooded all over the internet, and it's quite ironic that he has both email adresses.This leads me to believe he has recieved them through some other means besides organic.
From my understanding most AM's do not tolerate this approach at recieving players.

Well I have recieved two more since my last post and notified his affiliate at party poker. I asked for a reply back from Party Poker concerning this issue and the fact that they would look into it as it is not an ethical approach at obtaining customers. I recieved nothing back from them...so I will wait and see if he does it again. If this happens than I know Part accepts people like this and I will contact his hosting company. Normally I don't take this approach but there is no way he could have recieved my affiliate account address...plus he has PM;d me with my member account at Poker Analysis...so of course he is spamming.
