I have sent a pm to GPWA Nancy (who oversees private member applications and seal approvals) to institute appropriate actions. Certainly the seal needs to be removed from the site as an immediate action, and then we need to follow-up to determine which further actions might be necessary. Certainly a webmaster engaging in intellectual property theft cannot remain a private webmaster here unless they agree to work diligently to put matters in an ethical place.

I'm delighted to see you guys are going to deal with this person. And I am glad I chose to bring it to your attention. I'll be honest, I just wanted my article removed, which he did, however I didn't think it was fair on other, unaware writers.

It just bugs me, the sites state the articles can be copied unless otherwise stated. Providing they aren't altered and the links remain. But he isn't doing that with any of them (keeping any links). Plus, the fact the full site is based on copied articles speaks wonders.

People like this need clamping down on!

I'm starting to work on this now. It appears Libertybell was approved for Private Membership way back in February 2004 so he has been around for quite awhile and both sites were approved for the Seal in February 2010. I will post additional info as I have it.

    Email to Libertybell
    Hi James,

The GPWA has received word that articles appearing in your website, www.gamblersdestiny.com are displayed without following and abiding by standard copyright laws and business ethics. As a Private Member of the GPWA and having GPWA Seal Approved websites, it is critical that the terms and conditions set forth by sources/authors are abided by on your end. Both of your websites passed the GPWA Seal review in February 2010 so we are not quite sure why there are copyright issues now. Until the copyright issues are corrected and sources are properly noted and displayed (or the content is entirely removed), you will need to remove the GPWA Seal of Approval from Gamblers Destiny.

There are sites where free content is available to reprint in your websites (Ezine Articles, Wikipedia and more). However, there are specific terms and conditions with each of them that must be followed when using/copying content from them. We will need you to review and update all the content received from other sources within Gamblers Destiny and The Bingo Shack and implement the proper terms and conditions set-forth or remove the content from your websites entirely.

If either of these sites have been sold and you are no longer associated with them, I would appreciate if you could tell me who the new owner is and if they are a GPWA Member.

I look forward to hearing from you.

    Kindly,

    Nancy

    Reply from James (Liberybell)
Please feel free to reinspect both sites again. The matter was taken care of with in 24 hours, and said article was removed. I sent resolution email, and received no response from the complaintant. I did do my part and hope I am still in good standing with the GPWA.

    Thank You,
    James MacMaster

    My Reply
    Hi James,

I viewed some of the areas of www.gamblersdestiny.com. Although some sources and their links are now displayed, I still see copyright issues.

Articlebase states the following requirements: “Honor the author! Articlebase.com requires that you leave the original author name, article title and resource box intact. Please see our Publisher terms of use, before posting this article”. This is not being adhered to in all articles displayed.

Not all articles contain links back to the original source. Here are some examples:

Rise of Sin Corporations - On the Web Gambling (link to original article missing)
Internet Gambling For Newcomers and All Individuals (link to original article missing)
Are Gambling & Lottery Two Different Names of the Same Game? (link to original article missing)
    and more.....

Casino Games a?? Roulette from Wiki Casino Games. Does this site allow content to be reproduced? Where are the terms & conditions concerning the reproduction of their content?

I did not view www.thebingoshack.com but the same copyright rules apply for this site like all sites. If this site has the same issues as Gamblers Destiny, it needs to be updated properly to abide by copyright terms or the content needs to be removed.

At this time, the GPWA Seal has been deactivated (the link) and we are requesting that the Seal be removed entirely from the site until all copyright issues have been cleared up. Once the site is ready, please let me know and we will perform another Seal review. Once approved, you will be able to display the Seal again.

I have attached a small file that states the basic Do’s and Don’ts for copying content. If these are followed, there should not be any problems relating to this issue in the future. The main point is, if you didn’t write it yourself, somebody else did and that person needs to be referenced/linked or whatever terms they state in order for you to use their material. If there are no terms and conditions displayed regarding reposting, it is required that the author be contacted and permission be granted from them (verbal or written; although written is better of course) for you to use it.

Feel free to contact me if you have any questions regarding copyright issues and let me know when both sites have been reviewed and updated so we can conduct another Seal review.

    Thank you

    Nancy

I don't have time today, but the other day when I looked at the site I saw NUMEROUS articles that were copied and did NOT have any resources listed....and the 4 or 5 articles I checked were all posted on many sites word-4-word....

I have not yet received a response from James since my last email to him. I looked at Gamblers Destiny and the Bingo Shack websites this morning and the GPWA Seal of Approval has been removed.
