Court/s of Costa Rica is NOT handling complaints against online operations which have a Gambling License under Costa Rica Jurisdiction !

How ODD can that be? Well, I do not know if the same goes for Curacao (Atlantis Gold Casino jurisdiction), but there are many like that!

In the absence of a definitive time limit, the law sides with the consumer and uses the minimum; i.e. 1 day per $2000.

I don't plan on filing a lawsuit - the Casino will do what's right.

But you don't file through the Courts of the local countries; you file through the WTO or IMF; of which both countries mentioned in this forum are signatories. Visa and MC are US companies, and they refund your money out of pocket; but the international monetary exchange policy (because there is a currency exchange component) makes it a matter for the international court, of which those countries are signatories. The Hague is a powerful venue if you're not the US, China, or Russia. Everyone else pretty much listens to what they say.

My point is that we do have recourse, in that you can get your deposits refunded, and if you have the time and energy, you do have the means to take action -- you just need to know how to do it.

It won't come to that in this case -- I have every hope that things will work out.

My terms of service with Visa say nothing about online casinos. I also said "banks" to collect restitution. Visa is not a bank. It's an important distinction.

Yes, I know this, but what to do when you have profits and your all time deposits at the casino are a small percent of what the cashier balance shows ?

I'm happy to take this discussion offline; as it would be inappropriate for me to offer legal advice. I can show you examples of what others have done in similar situations with great success.

Yes, there are ways to recover money from online casinos in many many cases, but the courts is usually NOT the recourse that one would take to get results, whether you think filing through the WTO is correct or not.

Yes Visa and MC are US companies, but they also have pretty specific terms not to use the cards for gambling, and they often consider online gambling establishments in other countries, illegal or off limits to their US based customers. Yes they have often been known to proccess refund/charge backs for customers, but they have also been known to close those accounts after the fact.

Also, if you do proccess chargebacks after a casino, you can also end up on lists that would disallow you from playing at other casinos using the same software.

By filing your case with Askgamblers, you have already taken a good step in order to get your cashout resolved, and it is very common for a number of casinos serving US players to have the $2000 per week limit. I do not like it, and I think it should be changed, but this is something players have had to deal with for many years now.

Rick - Do you agree that the "Terms and Conditions" that players have to check "I agree" is an agreement? It's a bilateral contract. When one party defaults/breaches the contract after the first party (the depositor) has upheld his end; the entire agreement is considered void and damages are awarded if applicable.

If Atlantis can't uphold their own terms -- then they should re-write them. They have all the power in the transaction to write the 'contract' and they wrote a rather stupid one -- and that's on them.

I'm not going to sue them. That's what anti-gambling advocacy groups are for -- I'm pro online gambling and wouldn't want to hurt the industry. But I do want Atlantis to be pressured into fixing the problem. Let's self-police. They'll listen to you guys -- they won't even respond to me.

I'm talking about several thousand dollars -- not over $5K -- it's not going to break their bank -- but I played by the rules, I won by the rules, they need to cash out by their rules - not remake them at their convenience. There is no "per week" limit in their policy.

Hell, they won't even process them - it says "pending". So much for 72 hours....

PS: Visa and AMEX do not make all cards or cardholders equal. The bank behind the card is who I'm referring to - JP Morgan, WellsFargo, etc. I don't want anyone reading these posts to confuse Visa/MC as banks. Two separate sets of rules.

I understand where you are coming from right951, but it is pretty clear that you are fairly new to the industry. I am not trying to be cruel, but thousands of players have complained about this for many many many years, and it's not that the industry has not tried to adjust to this problem, it's just that due to many banking restrictions, and the fact that casino want to hold on to the money (know that they can) do so.

Yes it would be nice if all casinos cashed out all winnings right away for ALL players, but that just does NOT happen.

The complaints about no pay and slow pay are about the largest volume of all complaints on all properties.

Years ago when Neteller was the leading eWallet and it still worked for US residents, this was not near the problem it is now.

Costa Rica do not issue Gambling licenses. You get a data license which really means nothing.

"Not long ago Costa Rican Government has introduced a new law for obtaining an online gaming license." The new license clearly states internet gaming” as the licensed business activity. It takes 1-2 months to process the license and have it registered. And it cost $15K, plus $1.5K each 3 months.

Really. News to me. You can still get processing with the data license so not sure why anyone would spend 15k for a CR "internet gaming" license. It's still worthless.

You are correct on this. However, some choose to spend some money for image and credibility.

But yes, as you said, for the punter is still worthless if their country Court can not handle a lawsuit case on this issue.

image and Credibility with a CR license. lol. Anyways, I guess it's the best option if a brand chooses to go the central America route. Pura vida!

Right591, this (quoted) "the 1st incremental payment will be cut today for $2,000 and you should be able to receive the cheque in 3-5 business days from now" is what they have told you on 18 June 2013. - As I count it now, today is the 8th business day since then. - Have you cashed that $2000 or not ??

Upon his response to my last question, I can understand that he has received $0 (zero) from what he is owned.

He should receive $2000 as first installment of the payment, but he received nothing of it as of now. How nice ?
