Default India considering new regulatory framework that includes online gaming

India's Ministry of Home Affairs (MHA) is considering a new central law to govern online gaming, gambling, betting, and lotteries. A high-level meeting of MHA officials, including representatives from the Intelligence Bureau and other agencies, recently discussed the issue, according to a senior government official.

    From CNBC:

“It has been decided that MHA’s Indian Cyber Crime Coordination Centre (I4C) will prepare a report based on the discussions regarding the need for a new law to regulate online gaming, gambling, betting, and lotteries. Since these activities are expanding rapidly, a decision will be made once the report is submitted," the official told News18.

A query sent to Union Home Ministry on the matter a week back remained unanswered.

Currently, the Government of India has assigned matters related to online gaming to the Ministry of Electronics and Information Technology (MeitY). The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, framed under the Information Technology Act, 2000, impose obligations on intermediaries, including online gaming platforms. If they fail to observe due diligence, they lose their exemption from liability for third-party content.

Nothing will come out of this. They've been going back and forth about regulation for years. They need all states to agree on it, and the ones that already legalized some form of online gambling will try to oppose it, to protect what they have. Plus Hindus and Muslims don't really get along. They're always fighting about something in the Northern parts of the country. So, to see them agree on something together, will likely never happen.
