    In Hungary during a bank robbery an old lady is standing at a machine to fetch some money or something else. The robber finished his new occupation, fearless lady followed him, and after a short scuffle Super Grandma takes the robber mask off.



    Thanks to her aid, police now have a wonderful picture from the offender.

    This year GPWA was full of surprising and exciting moments.
    GPWA member johnjohn24 was exposed as an AffPower shill.
    A little Russian troublemaker gang tried to harm Star Games. These people are a shame for their country.
    We saw the demise of Club Gold Partners, AffPower and AffEurope.
    And the rise of Long Harbour Gaming.
    Some other sponsors were only a one-month-wonder.
    Michael Schumacher health situation was mocked, and criticism about that was responded with censorship. One of the really black weeks.
    The public witch trail here on GPWA and on AGD against Miss Becker of Europartners was a complete flop and disservice but a good chance to unmask some people.
    This year many GPWA members were unsmasked.
    And a hacker has kept us in suspense.

    But some things changed.
    It's no longer so easy to became a GPWA sponsor with quotas, with first click cookies and pitfall terms.
    It's no longer so easy to talk silly staff about everyone and everything, without humor or any sense.
    No longer so easy to come with twenty listless written 3-word posts on the monthly list.

    This thread has more than 60.000 views. That is more than I had expected. I will continue to publish uncomfortable truths and wonderful truths.

    This year GPWA was full of surprising and exciting moments.
    And now exactly this year is over for me, because December is a special month.

    The last time we drove to the dog hairdresser, my wife and I we saw a complete yellow house in our small village. "It looks so strange." my wife said to me. A few days now before New Year's Eve the house exploded because of tons of hoarded fireworks. Nobody came to any harm. But the yellow house is gone. It was the first explosion in our village since World War II. "What does the artist want to tell us?" I don't know. Perhaps "2014 was not a good year for yellow houses?".

    Anything else?

    Oh, after watching their new casino games I have to talk about Poker Stars again this year. They are really taken uninformed players for an idiot. We will talk about censorship if it is reality or only an illusion of quantum entanglement from another dimension. We will talk about the stressed people behind the websites and many other things that will make a lot of people so happy.

    25 years old German sentenced in court to a pecuniary penalty for playing in online casino

    This entry in my lucid diary can certainly be considered remarkable, particularly in view of the fact that it's the first time in my country, that a player was sentenced in court for playing online. We have no case law here in Germany, but our criminal code since a very long time is very clear:

    Section 285
    Participation in unlawful gaming

    Whosoever participates in a public game of chance (section 284) shall be liable to imprisonment not exceeding six months or a fine not exceeding one hundred and eighty daily units.
    "Whosoever participates in a public game of chance (section 284)"

    Section 284
    Organising unlawful gaming

    (1) Whosoever without the permission of a public authority publicly organises or operates a game of chance or makes equipment for it available shall be liable to imprisonment not exceeding two years or a fine.

    (2) Games of chance in clubs or private societies in which games of chance are regularly organised shall be deemed to be publicly organised.

    (3) Whosoever in cases under subsection (1) above acts

    1. on a commercial basis; or

    2. as a member of a gang whose purpose is the continued commission of such offences,

    shall be liable to imprisonment from three months to five years.

    (4) Whosoever advertises a public game of chance (subsections (1) and (2) above), shall be liable to imprisonment not exceeding one year or a fine.
    The 25 years old master painter played Black Jack with huge bets in an online casino in Gibraltar. Never before any player from Germany was caught and sentenced, but he made some big mistakes.

    He cashed out 11.500,00 EUR, 16.500,00 EUR, 73.500,00 EUR, 50.000,00 EUR and again 50.000,00 EUR via wire transfer to his private bank account.

    Oh ... after 9/11 ... if you receive a lot of money from another country on your German bank account, then the bank have to report money laundering or terrorist financing suspicions to the police behind your back. If this kind of suspicion will be reported, than the police will get for sure a search warrent.

    No judge here in Germany will undersign a search warrent only for allegedly playing with some bucks in an online casino.

    So in this case obviously they got the search warrent and found in the house a Tommy Hilfiger shoe box, filled with 73.490,00 EUR in cash. 10.000 EUR belongs to the mother. The rest of the money was confiscated.

    On 26. September 2014 he was sentenced in Local Court in Munich to a pecuniary penalty of 2.100 EUR, 70 daily rates of 30 EUR., registered as Case 1115 Cs 254 Js 176411/13.

    The judgement has not yet become final, but his chances are below Zero, because there is no way around of our clear criminal code regarding playing in online casinos without a German (!) license. An e.g. European license or license in another country is worth nothing. Playing under this condition is prohibited for all German people.

    Sidenote: The online casino refused to cooperate with the Public Prosecutor. The only good news.

    Guiding principle: A German player should never transfer winnings to his bank account.

    Conclusion: Online casino manager should know the risks for German Highrollers.

    Is this something that has existed for a while and is only recently being enforced or used in an actual case?

    Do you know if the specific case you mentioned is the first instance of the section being used?

    Criminal code and section 284 were published on 15.05.1871. At that time It was written e.g. for people, who played cards for money in honky-tonk backrooms.

    1990 was the first time, a supreme court decision was made regarding section 284 and sports betting. Around 2006 the first court decisions regarding online casinos and section 284 became public. But at this time decisions were made because of advertising gambling (online casino banner) and not gambling itself.

    Regarding playing in online Casinos? Yes ... partially. Some years ago there was another case (also in Bavaria! - Very strict state), but that decision dealt mainly with fraud (document forgery). Playing in online casinos was sentenced too, but only as a secondary matter. Without the fraud playing in online casinos have been never brought in court.

    The current case with the master painter is the first decision in Germany where playing in online casinos was brought in court, without any other crime, the first time section 284 and 285 ended for a player into a judgement who did nothing more than playing online.

    It seems the same around Europe! Banks report often about transfers,
    but they never report about $1million< managers bonuses while bank is at loss.
