Default Affiliate discusion with Ladbrokes Affiliate Program

Hello! I have a problem with one of most trusted online bookmakers- Ladbrokes.
I will try to explain the problem shortly:
I'm affiliate partner in Ladbrokes from 4 months. My site was new and after just 2 months i decided to change conception and paid to programmers to build new platform. They cleared all information, including all banners. Before 2 weeks i received mail from Mr.Nikesh Tailor (
    Ladbrokes Affiliate Executive):
    "
We have been reviewing your affiliate activity over a number of weeks and it appears you are not promoting Ladbrokes. In accordance with 4.1 and 12.3 of the terms and conditions we are giving 4 weeks written notice that your affiliate account will be terminated without further payment. "
I explained situation, but the final answer was:
    "
You have not been adhering to our terms and conditions and are having payments suspended. By joining the affiliate program you agreed by our terms and conditions which you have broken. "
I accept their decision to terminate my account, but can't accept the fact that they don't want to pay my last commission. I think that i deserved my payment, and even as they have legal rights (as i accepted their T&C) their treatment is not fair and ethical!

As i'm not sure what to do, I hope to see your opinion about the problem.

I can see the terms and conditions and why they can close your account etc but i cannot see were it says they are entitled to withold any payments due

12.3 allows either party to give 4 weeks notice and 4.1 is as follows

4.1 Throughout the Term, you shall prominently incorporate and continually display the most up to date Links provided to you by Ladbrokes on the Partner Site in a manner and location agreed between you and us and you shall not alter the form, location or operation of the Links without Ladbrokes' prior consent. If and when we approve your application, the Partner Site should display the appropriate Links within 4 weeks of being notified that you have been accepted. If you fail to so display the Links we may terminate this Agreement immediately on notice.

I just cannot see how they can withold payment

That said they do have a clause that it must br a min of £50

    What is the figure owed

But even then if they are terminating, any outstanding payments regardless of the amount should be paid whatever their terms and conditions.

From what i can see this seems very wrong but thats only based on what i see and read in this thread.

Also very strange that they would terminate your account once you explained why, just dont make sense

    Thank you for answer!
The figure is over 1000E and i start to think that they just don't want to pay big commissions. And yes, the situation is very strange, because this is Ladbrokes- one of most trusted names in Gambling industry! I already sent complaint to Gambling commission and waiting results...
As i can see, you are familiar with similar bookmaker discussions and i will be grateful to hear more ideas how to protect my rights and receive my commission.
    Thanks in advance

How many months were you a member of the affiliate program for?

Perhaps you could also post the URL to your site here?

I read that sentence as saying that they are giving you four weeks notice that there will be termination and no further payment (after that date).

As BetPartners has said - I'd expect all owed monies to be paid out on termination of the contract.

Have you had a discussion with Ladbrokes directly to confirm whether this final payment will happen - or have you assumed something?

A payment of Euro 1000 is NOT a big commission payment for Ladbrokes.

Agree with The Gooner here €1000 is not something that Ladbrokes are going to keep from you without just cause.

I also concur with The Gooner that having read your post again it does appear that they will terminate payment after the 4 weeks,

But i still cannot understand why they would terminate an affiliate that is making them money without a very good reason.

It would be interesting to see the URL in question and to ask you have you changed the banner codes at all or contravened any of their marketing policies?

I too would like to see the site in question and hear of any other reasons they have given for this.

"We have been reviewing your affiliate activity over a number of weeks and it appears you are not promoting Ladbrokes. In accordance with 4.1 and 12.3 of the terms and conditions we are giving 4 weeks written notice that your affiliate account will be terminated without further payment. "
If that is all that they have said and it is the only reason it seems like an "if i cannot play then i am having my ball back" situation.

Before few hours i received a mail:

    HI Diana,
We have not been in contact because our fraud department have been investigating your account. They have not found anything negative and your payment will be made after which your account will be suspended after 30 days of the previous email.
I hope this settles the matter.
    Kind regards
    Nikesh

Thank you for solving the problem!

Ok so they are paying you then, that was to be expected.

Seems they have their own reasons for not wanting to partner with you, may it is the type of player you are sending, i dont know but at least you are gtiing paid now.

Its good that they are paying you but i would be concerned that although they say that they have found no fraud they still want to close your account.

Sounds like they are saying there is fraud but we cannot prove it!

I would ask them to work with you to solve the issue even if the outcome is still the same, this will hopefully save you from further problems with other programs in the future.

I want to repeat my question:

How long have you been an affiliate of Ladbrokes?

To Renee: Im affiliate partner from 4-5 months.
To Chalkie: Yes, they tell me that after my site is ready i can apply for affiliate partner again. Bad for me that i'm losing my current clients, but...in that moment i am satisfied with this result.

    No that is wrong

If they are saying you can apply again then it follows that they have no worries about you etc and therefore it is well wrong if they close your account and take your clients.

You really need to ask them about this.

It cannot be that they close your account, you lose your clients, then they let you ahve another account.

Would you not be worried that they would do this again to you then?

Thank you for advice, but i'm not so sure that i will join affiliate program again.
Now i have problem with programmers and this payment will help me to solve the problem faster, thats why i'm happy for now.
When i finish with work on my site, i will decide what to do and what bookmakers to promote.

If they close your acount and then allow you a new account once you are back up and running then i would be demanding my players back, unless of course you are on CPA and not Rev share.

Are you on rev share or CPA?

Curious about that question as well, since that would be the only logical answer to why they are closing your account and letting you open a new on if you are on CPA and they only accept you to sign up with rev share.

I personally feel this is a predatory term.
