    So if I bring in 200 customers in one year and 0 customers for the next 10 years you can reduce the original commission for the first 200 players I brought that are still playing?

    We will never reduce the commissions under 30%, but should an affiliate be given a special deal greater than 30% and they do not stick to the deal to keep activily promoting the brand they *can* have the commissions reverted back to 30%. However this is dicussed with the affiliate before being given the deal and to this day we have never reverted an affiliates commissions back.

    explains the terms and conditions of the bet365 affiliate program and these terms and conditions have been in place over five years.

    PS, I had a quick look at your site and saw no reference to bet365, nor a reference to your name in our affiliate database, are you an affiliate of bet365?

    In the event should an affiliate send 200 depositing customers we would not be reverting the commissions back as this would be a bad business decission for us.

    If what you are saying is correct (and i do not doubt your word), perhaps the terms should be rewritten to make this clear because at present it does really leave you with the right to close an account and not pay up if an affiliate stops promoting even if they are not on an extra deal!

    Chalkie,

    The terms and conditions were written before I joined and I read through them after coming onboard and believe it is one of the fairest terms and conditions I have seen. This clause is in place to protect the company, and at no stage does it mention that we would not pay the affiliate for the life of the player (as we do, and have done for ten years).

    As mentioned before the commissions shall not be reduced lower than the standard commission structure

    While I have no doubt as to your intent or decision to do anything, the terms and conditions as currently written (unless I am missing something) imply a base commission of 30% (clause 1.3) which you are entitled to reduce pursuant to clause 6.

    The terms and conditions could be amended to represent your position as follows:

    1.3 Pay a Referral Commission
    Subject to clause 6, we will pay you referral commission ("Referral Commission") of 30% or as otherwise agreed of the net profit (defined below) we earn from players directed from your site after they open an account with us and wager for real money at either Sports at bet365, Casino at bet365, Poker at bet365, Games at bet365 or Bingo at bet365.

    John,

    The terms and conditions were written by a team of legal experts and I for one would be wrong to advise or suggest changes as that would be considered changing the terms and conditions retroactivily which in its own right will create an outroar from members of this very forum, as well as other industry boards. For this reason I prefer to leave the t&c's well alone.

    We mention nowhere on our site that we would ever reduce commissions below 30% and have never done this. We have never had an issue with an affiliate regarding our terms and conditions.

    No probs. My point was merely that despite whatever you intention may be or your past history the terms and conditions as written do entitle you to reduce referral commissions below 30% (Clause 1.3, i.e. the right to receive 30% is specifically expressed as subject to Clause 6 - the right to reduce commission percentage). I think you will find the general attitude amongst affiliates is that if a program has no intention of doing something, why include a mechanism by which they can in the T&C? There a many many less reputable programs then yourselves that may suddenly have a change of heart.

    Good luck with the program. I know it has a history of success and I'm sure it will continue to prosper.
