    Default Referral Agreements?

    Wondering everyone's opinion on having to sign referral agreements in order to be paid even though at sign up you have already agreed to the T&C's. Sounds like something more from the "sales prevention" departments. Here is an example.



    1. Affiliate is in a position to refer potential clients/customers to XXX Affiliates Company.



    1. On the date of entry into force of this agreement, the affiliate may send potential customers/clients to the company. The company will pay the affiliate a fee for these services based on the monthly revenue.



    1. We will pay to the Affiliate the advertising revenue on a monthly basis, by the 15th of the next calendar month. If you fail to achieve the minimum amount of 100 Advertising Revenue on a certain month, the earned amount will be forwarded to the next calendar month. All payments will be due and paid in Euro (EUR) currency. In case of a negative balance, negative carry over will not be performed by default. Advertising Revenue will be based upon our good faith calculation based on our statistics. The exact payment method is chosen by the affiliate through a prior agreement with Us.



    1. Representations and Warranties. Both Parties represent that they are fully authorized to enter into this Agreement. The performance and obligations of either Party will not violate or infringe upon the rights of any third-party or violate any other agreement between the Parties, individually, and any other person, organization, or business or any law or governmental regulation.



    1. Termination. This Agreement may be terminated at any time by either Party upon 30 days written notice to the other party. Upon termination, Company shall pay Affiliate all compensation due and owing for referrals made prior to the date of termination, but not yet paid.



    1. Entire Agreement. The Parties acknowledge and agree that this Agreement represents the entire agreement between the Parties. In the event that the Parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both parties.

    I think it is just legal BS too. Serves no purpose. Unfortunately some sales prevention departments can really interfere with programs ability to grow and build relationships. Certainly there is an appreciation for the need for procedures/compliance, example KYC documents, but some really go over the top. It really is difficult to play the game when the rules keep changing.

    No, never heard of it before in the 15 or so years of being an affiliate. It sounds pretty weird to me and this could be just another way of making affiliates jump through hoops.

    I had to sign one with VBET. They were the only ones that asked that of me, can't say that I like it. On one hand, it's okay because both sides are protected, but on the other hand, it's too much hassle.
