Just so everyone is aware it appears the affiliate systems are now down which makes it difficult to get a complete figure of earnings for the month. If you haven't calculated your earnings you may want to drop them an email.

I expect lifetime to mean lifetime of the brand. If not then they have lied and mis-sold which is illegal under Uk advertising/contract laws.

Their affiliate site is down for me too. Not good.......
How are we going to invoice them for January then? Or did they just get 4/5 of a free month's advertising out of us before binning us off for a low pay-off for all our customer base.

Fortunately for me I haven't sent any traffic their way in ten years. And all the revenues I've been getting monthly have been from five players that I generated back in 2007. Still, they should buy me out if they're going to discontinue paying me the 'lifetime' revshare.

We promoted all of the Cashcade brands, and they have pulled all the affiliate pages from all of the brands.
Whilst I did take a look through the T&Cs when this broke, unfortunately I didn't copy the whole document. Did anyone else?
A couple of points that are pertinent to the legal huffing and puffing here;
1) the T&CS did state;
As I mentioned above
""TERMINATION IS AT WILL, FOR ANY REASON, BY EITHER PARTY. For purposes of notification of termination, delivery via e-mail is considered a written and immediate form of notification.
Upon termination, the following provisions shall apply:
If we continue to permit play from customers after termination, this will not constitute a continuation or renewal of this Agreement or a waiver of termination.
You will continue to receive commissions revenues with respect to the profits generated from your players until the end of the calendar month in which this Agreement was terminated. ""
2) IIRC it said that the contract/T&CS were under the laws of Gibraltar, not the UK.
Whilst the first part of this is obviously downright unfair, it is in the contract that we all agreed. Whether or not a lawyer could argue that the terms were unfair and noncommercial (and that 'lifetime' means 'lifetime') and thus illegal, is a moot point.
The fact that the T&Cs are under Gibraltar law, probably due to the fact that they were written years ago when they only had a Gib license, is a separate point. And I dont know what difference that might make in any legal discussions.
If you are serious about taking action then you need to talk to a decent contract lawyer because you are guessing at the law and your assumption that their unfair terms are enforceable is very wide of the mark in my view, which is based on discussions with a contract lawyer on a previous occasion. Unfortunately I sense a defeatist attitude in your post as you are giving reasons not to fight your corner. My guess is your company would have taken a bigger hit than anyone who has posted on this thread so far. If you actually do something about this you will be doing yourself and the entire industry a favour. As stated, I'd be happy to weigh in with some financial help if you or anyone bothers to stand up for themselves.
GVC Holdings has history, they own Sportingbet who did this exact thing many years ago (close, steal, reopen). They have swallowed up a load of dishonestly run firms, apart from Sportingbet there is Bwin, so it is par for the course and all their brands carry a huge risk now.
PS: It is the first set of terms and conditions that you signed up to that would be most relevant, not the much-amended latest terms.

Annoyingly their foxybingo site is still up. Yet their affiliate site is gone, and they no longer reply to my emails... Anyone have better luck?
-Shay- (28 January 2017)
No response yet from finance or affiliates, no email read receipts and no payment yet for last month even though invoice was approved..

Same. Seems to contradict their final email really. Looks more like they've just gone missing now rather than honouring the final invoices, answering queries and generally being ok human beings. But why should I expect ok human beings in the gambling industry? This is a corrupt, immoral industry at heart.

Still ignoring my emails.....
Yep, radio silence now and the program pages gone. Looking like a full-scale shut-down. Wonder if we'll get those compo payments in the email.
I haven't heard anything yet either and no read receipts but they could be waiting till this month ends before responding to us all.
I did just sent Kerrie Bonds an email and got an automatic reply:
Due to a company restructure I no longer work at cashcade / bwin.party
For all affiliate related queries please email - affiliates@cashcade.co.uk
For payment related queries please email - finance@cashcade.co.uk
No response as of yet from these emails though.

Not a good sign though is it. Looks like someone has just come in one day and decided to close the lot. The final email we received looks more and more confusing/contradictory when you look at their behaviour and the sudden abrupt deletion of the affiliate sites etc.
