    Default Lawyer sues Full Tilt

    A Los Angeles lawyer filed suit in California this week against Fulltiltpoker.com, Tilt Proof Inc., poker player Chris Ferguson, and “[John] Does 1 through 100” for non-specific violations of the UIGEA and various statutes from the California Business and Professions Code.

    James B. Hicks of the firm Hicks Park LLC is seeking injunctive relief and an unspecified payment for attorney’s fees.

    Hicks claims to be a member of the Full Tilt poker site in an attempt to establish standing to bring his claim, although he did not specifically claim in the suit that he had actually played poker for money on the site. Pokerati reports that the crux of his case is that Full Tilt is liable under California law simply for being accessible via the Internet to California residents.

    I read a bit on this this morning at PokerStrategy.com, seems Mr Hicks has/had an account at Tilt. Looks like a money grubbing leech...

    In 2002, Hicks received an ethical infraction for developing a 'frivolous lawsuit' against the purportedly deep-pocketed Mattel. The case quickly went nowhere when his copyright infringement claim was altogether unfounded. Within the past year, Hicks earned himself a suspended license for 30 days and has some time until the 2-year probation period ends. Full Story

    He was not eliible to practice law in March 2009. He had a 30 day suspension placed March 03rd, he became active again April 04th.

    I guess he's trying to make up for lost time/income.

    I guess he hasn't actually read the UIGEA, or any CA state laws..

    It still boggles me how people think it's illegal to gamble in the whole of the US. As far as I know, there are no state laws in California making it illegal for people to place bets online. The only thing they could do is enforce the UIGEA from one of the states where it is explicitly illegal to gamble online if they can prove that he gambled online in that state. Morons.

    Edit: I'm willing to bet he loses this case against the individual, and if that happens I think this will be a good thing for us.
