Legal update for iGaming affiliates in US

Hey guys! For anyone who is interested in applying for a license to operate in the US market as an affiliate and/or is curious about what's cooking from a regulatory perspective, take a listen to this video interview with lawyer David Schollenberger. Bottom line is you're going to need that license...or else you're taking a risk. On the bright side, he believes the $ it costs to get that license will become worth it once interstate compacting is in place.

Interesting video Becky, would recommend any US facing affiliates watch this. Sounds like it's not going to be easy for US facing affiliates at all. I didn't realise that operators could lose their licenses from working with non-licensed affiliates either.

US-facing affiliates are currently only promoting companies licensed outside the US (who is there legitimately licensed within the US to promote anyway?). Affiliate sites are full of firms like bovada, betonline, wagerweb, bookmaker etc - these firms are licensed outside of the US.
I think this is an interesting video, but does not apply right now in reality. Maybe in five years when there are some legitimate US based operators to promote then the points raised will become more valid to affiliates in that space.

Yep, all true & great points- I do think that the risks will become greater over time for affiliates who work with any US-facing online gambling sites who are not licensed within the US, but I cannot imagine the US gov't has the resources to dig into this too deeply. What I do think is true is that any affiliate who is working with or has worked with any operators who are taking US players and licensed outside the US will have a very hard time obtaining an affiliate license to work with US licensed online gambling companies. (that was a mouthful- hope you see what I'm trying to say- ha).

Also, the above mentioned sites are mostly sportsbooks and I cannot see online sports betting ever opening up in the USA so biz as usual for these affiliates, I say

Anyway, I think we're going to be looking at 2 camps here- affiliates who want to work with the US facing companies who are licensed in the USA and the ones who want to work with the US facing companies who are licensed outside the USA. Affiliates won't be able to do both. If its (a) they want to do, they will need a license (or 2 or 3 or ??) and a squeaky clean history.

That is a very interesting statement, because you should have a better insight to this point than most. Surely though it will just be 'when' rather than 'if'. I know the US can be stubborn in defying gravity but prohibition ended too.

It will be interesting to see how it pans out. Certainly if you did get licensed online sports betting in the US then huge pressures would be brought to bear on those firms licensed outside the US in order to protect those firms that were deemed 'legitimate' by the US authorities and the resultant tax revenue. I say that in full knowledge of the pressure that has already been exerted.

While this amount of detail might seem appropriate for operators who are collecting deposits and accepting bets ...
it seems totally irrelevant to internet affiliates who are marketing / sales focused.

I expect to see a lot of fixed "media buy" deals going through for licensed operators who want to get on unlicensed websites.

I read the application and that was scary enough and I have no intention of ever applying for a license in USA .Media buys are the way to go in future for US licensed operators but I will not lose sleep over not working with the select few who do get a license.
