Default Paddy partners: at least one monthly customer or...!!!!

In terms and conditions we can read: "Paddy Power has the right to reduce the revenue share of affiliates, or to terminate this Agreement and remove such affiliates, who do not deliver at least one new Customer in a given calendar month. We will notify you by email where such a reduction or termination will occur. Accounts that are inactive for a longer period (e.g. where you have failed to deliver at least one new Customer in the last six months) may also incur an administrative fee but no such administrative fee will be deducted from your account prior to our having made reasonable efforts to contact you via the contact details last provided by you to Paddy Power. " Any of you has some informations about this? is a new customer intended as a depositing customer? has paddypartner ever applied this rule in the past, deleting an account? do you thing this is a fair condition? what happen to old customers referred untill termination? would they continue to generate revenues for life or simply would be deleted?

I don't think its a good move... specially after promising "life time" revenue...

    Hi markpurple,

In the T&Cs a Customer is defined as:
“Customers” shall mean visitors from your Site who enter the Paddy Power Site via the Links and who register (to include the provision of a valid email address and such other information as Paddy Power may require) and open an account with Paddy Power and where such visitor places a bet with Paddy Power or any of its partners on the particular product or service the subject of our agreement with you (for example, if our agreement with you relates to sports betting, only bets placed on sports betting will be counted, and not stakes wagered on games etc.). For the avoidance of doubt it shall exclude any end user that is at that time an existing customer of Paddy Power or any other company within the Paddy Power Group.

To the best of my knowledge, this clause has never been used.

thanks Luke, yes I know that paddypower at this moment has a good attitude (for example they never do negative carryover) and this is good. But terms and conditions are important, and it is necessary to understand some important points. is this clause saying that (when an affiliate do not deliver at least one new customer monthly) paddypower could delete accounts and ignore all future revenues from old referred customers? or is saying instead that paddypower could delete account but will continue to pay revenues from old customers?

They put our affiliate account on negative rollover after we had a particularly good month in terms of revenue. If it was left to the paddy power affiliate dept to run the affiliate dept then I am sure you could say "yes I know that paddypower at this moment has a good attitude" but it seems to me other people higher up within their company can tinker with the affiliate accounts. This happened to our account without even being told! I don't blame the affiliate managers, but it has changed my attitude towards paddy power for the worse - and we were sending them plenty of customers. Had to remove them from all the best spots - so they lose and we lose. Shortsighted.

This is actually not always good (referring to rev-share deals only!), there are many factors for a real trusted affiliate program/brand but if its doing or not doing negative carry over well, this is a minor one, not that important.

The real question is "WHY?" they are threatening to close the account. And there is no simple and straight answer to this simple question.
At least not in their T&C...
The best answer I found is that they just want to TAKE your old traffic from you and claim ownership on your revenue.
Very good for paddy - very bad for the affiliate.

Now that is a simple answer )

The simple truth from ocreditor: "Very good for paddy - very bad for the affiliate."

    ---

"Paddy Power has the right to reduce the revenue share of affiliates, or to terminate this Agreement and remove such affiliates, who do not deliver at least one new Customer in a given calendar month."

This is a really ugly term. In unlucky months a webmaster can have hundreds of clicks and no registrations. And what's about the small webmasters? This is more then unfriendly for them. Every program that still believes, only the big webmasters will safe the business, are on the wrong track.

And for the words "reduce the revenue share" and "terminate this Agreement" everybody need a anti-glare filter not to lose his vision.

"We will notify you by email where such a reduction or termination will occur."
"This happened to our account without even being told!"

    ---

"Accounts that are inactive for a longer period (e.g. where you have failed to deliver at least one new Customer in the last six months) may also incur an administrative fee"

    INACTIVE ... ADMINISTRATION FEE

    ---

"[...] but no such administrative fee will be deducted from your account prior to our having made reasonable efforts to contact you"

    "reasonable efforts to contact you"

    Really, Paddy Partners?
Like the way you made it with justbookies ("This happened to our account without even being told!")?

    ---

"To the best of my knowledge, this clause has never been used."

Paddy Partners, if you don't want to use it, then there is no need to write it.

In the view of small webmasters, these terms are an insolence!

Quotas are bad for ALL affiliates and I have been saying it for many years now.

Like Leopold said or quoted, if the term isn't gonna be used, get rid of it. I don't wanna hear that "we aint gonna use it" because the INTENT is there or the term wouldn't be.

I lobby strongly against any group that has quotas, and wish more affiliates did also since I feel if they had joined me in doing so many years ago, most groups would not now have any kind of quota.

I am sad that I actually do promote a few groups that now have a quota in their terms, but I will never knowingly add another.

Terms like this are no good for anybody as the people above have stated. I don't use paddy power as they initially rejected my application, around 2 months after applying and I decided that if that's how they conduct their business then I don't want to work with them. Throw in some terms like that, and as far as I remember it was only a two year revenue share when I applied then it just isn't productive to the smaller, starting affiliates.

Luke you seem like a good guy, and the above comment is not meant to slight you btw.

imagine that your site has got a temporary google penalization or for some reason in one month you could not deliver any new customer to paddy. do you think is fair to delete account? and my question is still the same, what happen to old customers future revenues?

Thanks. Just to clarify, our revenue share isn't (and never has been) limited to two years.

Was it no cross product revenue share then? I'm sure there was something ? I could be wrong. Thanks for clearing the above up.

Hi Mark, Clause 5.2 states "For the avoidance of doubt, you shall not be entitled to any revenue share in respect of revenues generated by Customers following the termination of this Agreement."

Voids, you are correct that we do not pay cross product revenue share, which we are transparent about (and has been discussed on GPWA recently).

To be fair to Paddy Power, their terms are all set out upfront (and quite clearly stated) - it's not like they're changing the rules halfway through the game (like a lot of programs do).

It's then up to you to decide whether or not to work with them based on those terms - I chose not to (for various reasons), but it's completely up to you.

Programs that add quotas after the fact, on the other hand, should be tared and feathered!

    Thanks baldidiot.

There are terms, such as the above, that we are constrained into including in our T&Cs due to being a PLC - as a PLC, we have a legal obligation to protect ourselves against future, unlimited liabilities.

We have a good, close relationship with the majority of our affiliates, and certainly affiliates who wish to have an active partnership with us. To the best of my knowledge we have never enforced this term, and definitely not with an active affiliate.

We understand several of our partners may not be able to send a depositing player every month - we strive to always be fair and flexible in our partnerships, despite what the T&Cs may allow us to invoke.

The clause is necessary as a public limited company and should anyone have queries or specific questions about this in regards to their account, please feel free to send me an email or PM.

My recent experience says otherwise Luke. You talk a good fight but unfortunately there are other people playing with the buttons at Paddy Power. You know I have endeavoured to talk through my problem with Paddy Power and got nowhere.
The PLC excuse is not credible. Paddy Power has the worst basic terms of any major program. There seems to be an attitude within PP that is opposed to affiliates rather than viewing them as partners. The person who altered my account without even discussing it with me ought to learn that Paddy Power will make far more money being fair with affiliates than changing agreed terms secretly.
I am not being personal here, Luke, because you have the decency to put your head above the parapet and engage. However personally I think you should be providing feedback to those making the decisions within Paddy Power that they will make more money (and that is all they really care about) by having terms that reflect the likes of Bet365 or BetVictor or Betfred. None of those firms are perfect but if you fell into line with them you would get so much more coverage from affiliates and therefore so many more referrals.

    Dear reader,

sometimes it's worth a second look what will not be answered. Scroll up to post #1, #2, #5-8. Than read the comments from today, and if you look above the cloud layer, you know, what i mean.

I might be in the minority but I am quite happy with Paddy Power and never had a problem.

To be honest I never knew about the crossover when I first started but I was granted product crossover when I asked years back

When I started off hardly made anything, but asked to promote a better free bet, got that, that helped, asked to have crossover added, got that, was asked for better spots, so asked for a new deal, got that

To be fair I send a **** load of players each month now, earn decent dough each month, they seem to keep the players playing and depositing, pay each month and don't roll over negatives. AND have someone answer problems on here

lot worse programs out there in my opinion

First, thanks for your post, its very important to hear some positive feedback as well.
Especially if a company/brand is considered trusted by affiliates.

    Second,
There is no argue about the fact that any affiliate affiliate program have the right to change/update (whatever) their T&C,
I still think that its a bad term and that this term will harm Paddy in the long term, because all the small/new affiliates
that are struggling to push a brand can't guarantee a deadline for delivering the first player... this term is actually reflecting the opposite of
what a trusted affiliate program should reflect through their T&C.
