For me no problem, - on the contrary - because I stay to my opinion, that no negative carryover is mathematical madness in the long run. This is the reason why more and more no negative carryover programs add (at least) a highroller policy and that's just the beginning.

"6.3 The commission is calculated at the end of each month and payments shall be performed by the fifth of each calendar month, provided that the amount due exceeds 50 mBTC and there are at least 3 active players during the running month"

My suggestion is to delete the words "and there are at least 3 active players during the running month" from the term because it's superfluous and for small webmaster an unnessecary burdon.

The activity quota is not something we have ever enforced, however in the interests of clarity we have updated the T&C's and removed this clause.

Would also love to get more feedback from affiliates on what else we could.

How about:

If an affiliate sends you a player that makes the casino positive netwin (player losses), you pay the commission (in currency) to the referring affiliate?

Plenty of programs do just that and many of them have been around for 10 years and more....
