Default Affiliates and Prison? APCW Perspectives for 1 September 2023

    Affiliates and Prison?

Could an affiliate really go to prison just
    for promoting an online operator?
At least one jurisdiction seems to think so!

Plus, there's new legislation in Malta that could
change the way operators and casinos do
    business in Europe!

AU affiliates; residing in AU, who promote "illegal" (non licensed AU online venues) not only risk fines, but I believe goal (jail) is also on the cards, too.

This is also the case in the UK too, promoting non licensed casinos has a fine of up to 500k and up to 1 year in jail.

100K a day here for individuals and it was either 500K or 1mil a day for companies. Goal is simply mental for something like this. Especially when a country like AU is steeped with a gambling history. I can walk less than 5 min any direction from home and visit a pub with pokies.

When society is handing out home detentions to pedophiles, locking up petty crimes; if they can be judged as even petty.

Sporting stadiums and such, taking presidence over no housing for low income earners, and the streets and cars are where some poor folks live.

The question should be, where did sh#t go wrong!

Yes, same in the UK, paedophiles walking, whilst people who choose not to pay every single penny to their self-declared owners, are jailed for tax evasion and similar crimes (like not paying the paedophile defending TV license extortion). Money crimes against the masters are far more severely punished. It tells you all you need to know about society. None of this relates to protecting the consumer, it is all about the money and who gets it.

But how to hold someone outside the UK accountable?

Like Australia, my guess would be they'd acquire you full details, and if you ever visited the UK or one of its territories, they'd nab you

Or they'd pull a USA DoJ act and issue an indictment for your arrest. They are far reaching outside the USA - only place safe Russian and the moon!

I remember not too long ago (details may be a bit off here). There were affiliates (possibly operators) arrested in Spain, this was due to offering gambling / advertising in Netherlands. They were arrested by the Spanish police.

I can't 100% remember the details, I have a funny idea I read about it here, or could have been local news.

Actually, it is a huge difference between being operators and affiliates. They were probably operators, not affiliates. It's hard for me to imagine someone getting arrested for having an affiliate site with gambling links

There are many laws which skirt the borders of insanity, and just plain common sense. These are exactly those instances.

I know that. You know that. However Governments who make these laws are mostly clueless.

Years ago (2 decades or so if I could find the thread here), a USA politician was trying to explain, in office, how internet gambling worked. Aside from it being the funniest thing I'd heard, it definitely proved a point that politicians should STOP trying to control sh#t they know nothing about.

I am more than aware of the difference between operators and affiliates. However what you seem unaware of is it is very much illegal for affiliates to promote unlicensed casinos. You can 100% get jailed for it, and receive huge fines. This applies to many European countries.

From memory, the story I refer to involves many people involved in the "crime" / operators along with affiliates.

    For example - https://www.gamingintelligence.com/l...tch-regulator/

My guess here is if he could not pay up / did not pay up, he'd be heading to jail.

You handled that condescending comment a lot better than I would have.

I would also imagine, if one resides in one country, and commits a "crime" in another country, if both countries are members of the EU, then my guess is that operator or affiliate is screwed, and the long arm of law will be able to nab and prosecute them.

In my country, from what I remember, three affiliate sites had problems. One that I know of paid the fines imposed on it, after which it moved to a .com domain and its owner went abroad. From EU country to EU country. However, that was X years ago. Probably in another x years the EU will be like one country.

Generally, it's all crazy, in any location. I remember the Gambling Act, how there was a push that it was for health and addicts, a total ban on casinos. The law went in, a while later the only legal state-owned casino was established. Of course, there you can not get addicted.

Sports betting was subjected to gigantic taxes, also for the benefit of the players now the real odds on ML 50/50 after subtracting taxes and margins are 1.50 to 1.50, of course for the benefit of the players.

100% correct, all gambling addicts do not matter as long as they are gambling in the correct places. The ones that can be controlled and make maximum money for the "rule makers".

I would love five seconds of the UKGC's time, to explain to me why they have zero interest in the UK breeding grounds for gambling addicts, where children are freely allowed to gamble on penny slots and other machines offering children shite prizes for big sums of money.

The Gambling Commission is quite simply a stealth tax on gambling companies. They will make any ridiculous rule to fine big companies. The big companies which then take their losses out on affiliates, many of which are small time people simply trying to make ends meet.

This is a great thread and should be documented for both players and affiliates.
