    I found myself bound to Ladbrokes in some perverted game.

    I send them many points what is needed. It starts with some banners that work everywhere but not in the UK or that they do not offer creatives in some languages or that they did not this, this or that what was promised.

    Their response? "You are now on 70-60-50 deal why do not push us harder."

    I ask them to make cobranded banners/landing pages, where would be written MYDOMAIN recommends Ladbrokes where MYDOMAIN.com is ofc my website.

    Their response: We need to clarify what is the MYDOMAIN.

    I am so surprised... they actually convert very decently in the UK for what they offer. And the bonus are the funny stories I can tell every evening to my gf. Much better than sex.

    How does the Ladbrokes Partners T & C stack up versus the Score Affiliates terms?
    I know Score has had a few incredibly dodgy terms in the T & C and have not heard if they removed them or not.

    Which "incredibly dodgy" terms are you referring to - can you be specific?
    There is so much "innuendo and mis-information" around on various sites that I don't have any idea what terms you are referring to.

    It would make it much easier to answer the question if you specifically list the terms.

    Under Score affiliates there were several problems. I have not got a chance to read the new T&C at Ladbrokes partners, hence the thread.


    I am referring to the Score terms listed here:

    4. The Links4.1 Throughout the Term, you shall prominently incorporate and continually display the most up to date Links provided to you by Ladbrokes on the Partner Site in a manner and location agreed between you and us and you shall not alter the form, location or operation of the Links without Ladbrokes' prior consent. If and when we approve your application, the Partner Site should display the appropriate Links within 4 weeks of being notified that you have been accepted. If you fail to so display the Links we may terminate this Agreement immediately on notice.


    4.5 Ladbrokes has the right to monitor the Partner Site to ensure you are complying with the terms of this Agreement and you shall provide Ladbrokes with all data and information (including, but not limited to, passwords) to enable Ladbrokes to perform such monitoring at no charge.
    4.6 If we discover that your use of any Link is not in compliance with the terms of this Agreement, we shall be entitled to take such measures as to render inoperative the Links used by you and to immediately terminate this Agreement without notice to you.
    12. Term and Events of Default12.1 This Agreement shall start on the date that we notify you that your application has been successful in accordance with clause 3. This Agreement shall continue thereafter unless and until terminated in accordance with clauses 12.2 or 12.3 (the "Term").
    12.2 Notwithstanding clause 12.1, either party ("Non-Defaulting Party") may bring the Term to an end with immediate effect by written notice to the other party ("Defaulting Party") if:
    12.2.1 the Defaulting Party commits a breach of its material obligations under this Agreement and in the case of a remediable breach, fails to remedy it within 30 days of the date of receipt of notice from the other;
    12.2.2 the Defaulting Party becomes insolvent or unable to pay its debts (as defined in Section 123 of the Insolvency Act 1986), proposes a voluntary arrangement, has a receiver, administrator or manager appointed over the whole or any part of its business or assets or if any petition shall be presented, order shall be made or resolution passed for its winding up (except for the purposes of a bona fide amalgamation or reconstruction), bankruptcy or dissolution or if it shall otherwise propose or enter into any composition or arrangement with its creditors or any class of them, or it ceases to carry on business or if it claims the benefit of any statutory moratorium.
    12.3 Either party may terminate this Agreement on delivery of four weeks' prior written notice to the other party.
    12.4 If you do not deliver 1 new customer registration within a period of three months (billed months) we may terminate this Agreement immediately by delivery of written notice to you.
    12.5 Each party shall forthwith give notice in writing to the other party of any event within clause 12.2.2 which occurs during the Term and which would entitle the other party to bring the Term to an end.
    12.6 Without prejudice to clause 12.3, we reserve the right to terminate this Agreement at any time and for any reason immediately by delivery of written notice to you.
    12.7 The parties shall have no further obligations or rights under this Agreement after the end of the Term, without prejudice to any obligations or rights which have accrued to either party at the time when the Agreement ends save that clauses 1, 2, 4.7, 4.12, 8, 9, 10, 11, 12.7, and 13, together with those other clauses the survival of which is necessary for the interpretation or enforcement of this Agreement, shall continue to have effect after the end of the Term.

    - They also retroactively changed affiliate agreements. I.e Broke contracts

    The US affiliate contracts is NOT in the terms - the only excluded list on Ladbrokes partners is for customers.

    Excluded Territories means the following territories, which may be changed by Ladbrokes from time to time: American Samoa, Australia, Belgium, Bulgaria, China, Christmas Island, France, French Guiana, Greece, Guadeloupe, Guam, Israel, Italy, Hong Kong, Martinique, Mayotte, Northern Mariana Islands, Poland, Puerto Rico, Reunion, Saint Pierre et Miquelon, South Africa, Turkey, USA, US Virgin Islands and United States Minor Outlying Islands.
    requirement of using up to date links is still there ... now at 6.1

    6.1. Throughout the Term, you shall prominently incorporate and continuously display the most up to date Links provided to you by any Business on the Partner Site in a manner and location agreed between you and that Business and you shall not alter the form, location or operation of the Links without that Business’ prior written consent. If we approve your application, the Partner Site should display the appropriate Links within four (4) weeks of you being notified that you have been accepted. If you fail to so display the Links, we may terminate this Agreement immediately on notice.
    I cannot find a minimum signup clause causing termination - but there is one for lowering share at 8.8

    8.8. We reserve the right to decrease the amount of your Revenue Share to a lower percentage if during any three (3) month period you fail to deliver any new Customers.
    There is a generic termination clause at 14.3

    14.3. Either party may terminate this Agreement on delivery of four (4) weeks' prior written notice to the other party.

    But I would suggest that you don't rely on ANYONE else's interpretation of terms ... and read them yourself.

    Indeed - we have not been paid for November yet either - and with Festive holidays affecting bank processing I don't expect to see it this month now. The new T&Cs seem to suggest up to 60 days from month end.

    8.5. Subject to clause 8.4, at the end of a calendar month, you may raise an invoice for the relevant Revenue Share payable by Ladbrokes to you, which shall be paid within 45 days of receipt by Ladbrokes of such invoice. However, raising an invoice is not a requirement as the relevant Revenue Share payable by us to you shall be automatically raised and paid out (in accordance with this clause 8.5) within 60 days of the end of the relevant calendar month. Such Revenue Share shall be paid in pounds sterling, inclusive of VAT if applicable.
    And if they fail then they will pay outstanding interest ... at a whopping 0.50 (Barclays base rate) + 1.00 = 1.50% per annum!

    16.2. If either party fails to pay by the due date any amount payable by it under this Agreement, the other party shall be entitled but not obliged to charge simple interest on the overdue amount, from the due date up to the date of actual payment, at the rate of 1% per cent per annum above the base rate for the time being of Barclays Bank Plc.
    Finally, and I HAVE found a component stating no USA affiliates or companies - (raised by PinkyToe above).

    4.2. You warrant, represent and undertake to us that you do not reside in the USA and its territories (if you are an individual) or your business is not registered in or operating from the USA and its territories (if you are a company).

    I still haven't been paid for November 2013 revenue, though I have received a bewildering reply from my aff manager, Saar. I was asked to sign a payment information form, which related to updating wire details, even though I'm paid via e-wallet. I explained this to Saar but was asked to sign and return the form anyway, with no wire information included. I've been told I'll be paid first week of January - we'll see.

    Likewise. No reply, no payment, and these guys wanted me to do special Boxing Day ads for them, even though they'd not paid me. What is going on? Can anyone explain?

    Suspending ALL ads before I lose any more referrals that are not paid.

    A recommendation is that you list all your problems and issues you have with the partner program and then one or several of you can take it up with them in London for the LAC conference, ok it is still 2 months away and I know it is not fun to promte a brand where you are left in the dark for a longer period of time, but face to face is always better then emails flying back and forth.
